"If you aren't guilty you can have a trial." Brandy, this is the most expensive sentence you've ever said and you didn't pay a dollar for it. Let me show you what "having a trial" actually means for the people you're so confidently advising. You are twenty-two years old. You are Black. You are from a neighborhood where the public school lost its art program in 2013, its counselors in 2016, and its after-school funding in 2020. You are charged with a drug offense. Your public defender meets you for the first time four days before your hearing. He has 300 other cases. He has reviewed yours for approximately eleven minutes. The prosecutor offers you eighteen months if you plead guilty today. If you go to trial and lose, and the conviction rate for federal criminal trials is 99 percent, Brandy, 99 percent, you are looking at twelve years mandatory minimum. Twelve years versus eighteen months. You have a child. You have a mother who depends on you. Eighteen months is survivable. Twelve years is the destruction of everything you have. You are innocent. You take the plea. This is not a hypothetical. This is the documented, statistical, court-recorded reality of how 97 percent of American convictions happen. And you looked at that and said: well, they could have had a trial.

Cleaners, laborers, and service workers make $, with a flat salary distribution that limits advancement.

I wonder if Sen. Smith realizes that for women to "talk to their own doctors" - and not be subject to their partners mail-ordering abortion-inducing drugs and covertly slipping it to them - the US would need to join the rest of the world in reinstating in-person requirements

@magi_jay But we may not even “see” it. All legal research tools already claim to be implementing AI. How much AI it implements will gradually increase, with no one admitting or recognizing how much they end up relying on “AI” to write their briefs.

AI is not just as capable as we are, tho. This is one of the most pernicious myths of AI, which should be abundantly clear to anyone who has ever used AI. This myth is endangering the human workforce based on nothing beyond Silicon Valley fumes jacked up by Thought Leaders.

@magi_jay Also, law is one of the most anti-progress and mistake-fearing industries. Enforced by laws and sanctions from old, tech-skeptical judges. Other industries will accept a surprising amount of error for the sake of speed.

@magi_jay Publicly available AI has limited applicability in serious professional settings b/c it’s too general. But the underlying technology can be harnessed for specific industries. AI replacement of legal jobs will not come from Claude. It will come from Westlaw and Relativity etc.

The discussion of Kelsey Plum bizarrely claiming she would have to pay an extra $13,000 in taxes if she earned a dollar more from her LA Sparks contract has ended up being an interesting window into Twitter dynamics. In particular, it shows how people look for any reason to dunk on a point made by an account they dislike, even when they have no actual response to the point. It also how the desire for traffic trumps any kind of critical thinking. Alex Berenson, for instance, tried to defend Plum by invoking NY state's tax laws, even though those laws are irrelevant to Plum's claim, since she lives in CA. And he attacked Plum's math (she's the one who said she would owe an extra $13,000) while blaming me for it. And he of course tossed in the obligatorily stupid reference to supposed midwits. Erick Erickson, meanwhile, just waved his hands and said "Her accountants must have told her this, and they must be right," without ever offering an explanation of how $1 dollar in CA income could translate into $13,000 in new taxes. This is just a silly way to argue. If you actually think a tweet is wrong, engage with the tweet itself and explain what's wrong with it. Don't, in your desperate desire to dunk, bring up red herrings or handwave and say "This can't be right," especially when doing so means you end up defending a ridiculous position.
