Since we're all being completely honest today, I'll jump in as well. The War Powers Resolution is functionally dead. My latest blog argues repeated failure to use the War Powers Resolution is not productive. It is time Congress to develop a new and improved tool because arguments like this from the modern Executive branch cannot stand. ⬇️

@bdquinn Oregon could be an interesting state to watch. At the state level Democrats don’t get above 50-51% with the GOP getting about 45%. Oregon hasn’t elected a freshman Democratic Senator with over 50% of the vote since the 1960. If Portland gets depopulated enough, it could happen.

This also doesn’t consider behavior changes brought about by other democratic reforms during the progressive era (e.g., the Oregon system) and its effect on state legislature selection behavior. There is also the Sims case which changed what a State Senate was.

I am not sure if indirect election would bring about a return to the Golden Age Senate. Charles Stewart III has done some good work on the politics of indirect election finding that behavior patterns didn’t change all that much.

Cloture is actually a motion to give the majority total power over the Senate though banning amendments and effectively block out any minority voices. If the majority doesn’t get their way in being able to totally control debate, then they don’t consider the bill.

Cloture votes are not a proxy for “filibusters.” Rather their rise represents consolidated leadership over the Senate. Cloture is filed even before a debate starts!

@CaseyMattox_ That makes no sense. The 17th Amendment was ratified in 1913. Filibusters were practically nonexistent for 60 years after.

@AeonCoin @AstorAaron I agree that MMP would destroy partisan gerrymandering. But even if only done at the state level, it could be argued to violate the “one person, one vote principle.”

We need a Constitutional Amendment (or maybe several) that does the following: 1. Bans Presidential pardons after Election Day (and before Inauguration Day) 2. Bans partisan and racial gerrymandering 3. Bans redistricting mid-decade 4. Requires Congress to increase the House

@AstorAaron Expanding the House doesn’t require a constitutional amendment nor multi member districts. Only a change in law. Implementing the Dutch system (which is PR) or STV wouldn’t require a constitutional amendment ether. MMP could require one.
