NEWS ON THE BALLROOM -- The $1B for USSS is one of the most important things Republicans are dealing with right now. It is the single provision that is standing in the way of ICE/CBP funding. Trump wants this on his desk by June 1. But that's all been complicated by the $1B for security, including Trump's ballroom. Forget the House floor right now. it's irrelevant. all the action will begin when the Senate moves the reconciliation bill. As @LauraEWeiss16 scooped last night, Senate is not only changing the $1B language, but they are also considering lowering the number from $1B. Senate is engaged in a lot of Trump management right now. They know Trump wants the money but they also know that, in its current form, they cant pass it. The parliamentarian is a side show, for the most part. Because if the language ends up on the floor, it could easily come out during vote-a-rama. And here's the real kicker: The House is even trickier. Absences and opposition will kill this provision in the House. Johnson has been warned by rank and file. To be a woman right now, especially a woman who loves men, is to try to reconcile the love and respect that you have for the men that you trust, with the utter loathing, disgust and sense of betrayal you feel toward men in general. I know good men. I know great men. And I know “not all men.” But what sticks with me these days is “not one man.”Not one man who went to that island and witnessed an evil incarnate thought, “I don’t care if it puts my life in danger, I don’t care if my family has to go into witness protection, I have to make these atrocities stop,” and took action. Not one man.

Okay. Some clarification. First, there are two types of agency inaction: (1) unlawfully withheld action and (2) unreasonably delayed action. Number 1 challenges an agency’s refusal to take action that it is required to take; number 2 challenges an agency’s delay in taking action it is required to take. Most petition attorneys who claim to litigate incorrectly call both of these “mandamus case,” but I digress. When @USCIS refuses to take action on #Iranians’ applications based on the PMs, the holding is unlawful if the PM is unlawful. This is a record review case because the legality of the PM is based on the record underlying it. So, the general rule in such a case would be no discovery. In unreasonable delay cases, there is no policy causing @USCIS’s years long delays for a single application. Because there is no one document, policy, or agency action that causes the unreasonable delay, there is no record supporting the legality of the inaction. So, discovery is required to figure out the factual reasons for the delay. But irrationally, @USCIS has for years argued that unreasonable delay cases are also record review cases. I have an appeal in the 9th Circuit on this issue right now. Claiming a delay cases is record review gives @USCIS the ability to delay and delay and delay unreasonable delay cases because they need “time” to produce the record. It also gives @USCIS the ability to cherry pick evidence to defend their delays without giving the plaintiff a chance to test USCIS’s factual claims. Finally, @USCIS does not like responding to discovery. Every time a @uscis official sits for a deposition there is a significant risk they say problematic things. On occasion, getting discovery alone is enough to force the government to settle. So, this foot note is significant for unreasonable delay claims, not necessarily for unlawful withholding claims.

10 Signs of #H1B #Trafficking: 1. Employer pays a % of billed hours instead of salary; 2. Employer asks you to pay for costs via Zelle, CashApp, or cash; 3. Employer refuses to issue pay stubs or issues fake pay stubs without actually depositing funds; 4. Employer requires you to pay your own salary; 5. Employer forces you to request unpaid; 6. Employer requires large $$$ penalty for leaving the company; 7. Employer expects you to find your own end client; 8. Employer insists you lie on your resume to potential end clients; 9. Employer agrees to file I140 that seemingly never happens; and 10. Employer deducts money from pay to pay off “debt.” We see this kind of behavior alongside threats to revoke or withhold #H1B, #I140, or other immigration status where the employee pushes back. These scenarios often constitute labor trafficking (though not always). The statute of limitations to recover wages and damages for #LaborTrafficking is 10 years. And victims of serious trafficking may qualify for a #Tvisa which can lead to green card that is not subject to country caps.
