It’s bizarre. A workplace is a place where you work.
Running for parliamentary election carries with it no employment, no employment contract, no income, no guarantee of anything, no workplace.
Under the jaundiced, biased NCAT ruling:
* Someone running to be president of a school P&C works at the school.
* Someone running for local government works for the Council
* Someone running for a position at a sporting club AGM works for the club
* someone running to lead a trade union already works for the union.
You only need to state these positions to know how wrong at law NCAT is.
The NCAT ladies presiding at this case lacked the legal expertise and competence to handle basic matters of law and commonsense.

The timing gap
📅 Latham resigned on 2 March 2023.
🗳️The state election was on 25 March 2023.
At the exact time of the tweet, he was:
❌No longer an MP.
🗳️A candidate running for re-election.
⚠️ Had no guaranteed job or income if he lost.
🎲No one could know for sure he would win his seat back (even though he was the strong favourite as One Nation’s lead candidate).
Why NCAT still ruled it was a “workplace”
The tribunal essentially said:
✅ Being a candidate in a state election for the Legislative Council is itself political work.
🏛️ Public statements by someone in that position are part of the “parliamentary and political workplace” under the Anti-Discrimination Act.
🎯 The law looks at the character of the activity (political speech by a prominent figure), not just formal employment status at that snapshot in time.
Latham’s legal team argues this is retrospective reasoning - you can’t punish someone for “workplace” conduct in a workplace that didn’t exist yet and might never have existed if he had lost the election.
This uncertainty (no guaranteed re-election) makes the “workplace” definition even more stretched, which is likely to be a key issue in the appeal.
📌Bottom line: NCAT prioritised the political context over the strict factual gap in employment.
🗣️Critics (including Latham) say that turns every political candidate or commentator into someone who can be hit with “workplace” rules even when they’re technically unemployed.
Irrespective of what you think of Latham, is that a welcome precedent?

My legal research team has studied the matter closely, and now concluded, following the NCAT ruling on Thursday, I am the first person in the history of the Australian legal system to be found guilty of a workplace offence when I had no workplace. At the time of the tweet they are so worried about, I had no job, no income and no workplace. I had resigned from the NSW Parliament. This bizarre ruling shows how NCAT is a disgrace to the concept of evidence and justice.
