BREAKING: The 8th Circuit, in a 2-1 decision, joins the 5th Circuit in endorsing the Administration's reading of section 1225(b)(2) as allowing mandatory detention of long-time non-citizens who had entered without inspection. This decision will subject countless non-citizens within the circuit's jurisdiction to punitive mandatory detention without an opportunity for a bond/release. This is the Avila case. The oral arguments on this issue are tomorrow on the 11th Circuit. We are waiting for the 9th Circuit to issue their decision which will also likely be 2-1. The question is which way.
