جج: ایک دفعہ دوبارہ آپ اپنے فیصلے کے بارے میں سوچیں۔کیونکہ جن بنیادوں پر آپ خلع مانگ رہی ہیں، وہ مضبوط نہیں ہے۔ نہ آپ کا شوہر بدکردار ہے، نہ مارتاہے۔ نہ ہی کوئی اور بڑا الزام ہے اُس پر۔صرف کفالت نہ کرنا اتنی بڑی بنیاد نہیں ہے جس پر ستائیس سال کی شادی کو ایک منٹ میں ختم کردیاجائے۔کیونکہ اگر ستائیس سال آپ کو اُس کی کفالت نہ کرنے پر کوئی مسئلہ نہیں تھا تو پھر باقی زندگی بھی گزاری جاسکتی ہے۔اس عمر میں خلع لینے کے سارے مسائل آپ کے بچوں کوface کرنے پڑیں گے۔آپ کو بھی face کرنے پڑیں گے۔Old age میں آپ کا ایک ہی بیٹا ہے، وہ بھیyoung۔تو ابھی تو وہ آپ کو اس سارے معاملے میں سپورٹ کررہاہے ۔لیکن آپ مستقبل کے حوالے سے سوچیں جب اس کی اپنی فیملی ہوگی۔ زیبا:کچھ اور کہنا ہے آپ نے یا بس؟ جج:نہیں فی الحال مجھے یہی ساری باتیں کہنی ہیں آپ سے کیونکہday one سے مجھے آپ کا فیصلہ بہت کمزور لگتا رہاہے۔کیونکہ میرا خیال ہے یہ آپ کا جذباتی فیصلہ ہے۔کوئی ان بن ہوگئی ہوگی، کوئیegoکی بات یا کچھ اور۔میرے ماں باپ کے درمیان بھی اس عمر میں ہوجاتے ہیں چھوٹے چھوٹے جھگڑے، کبھی کبھی بڑے بھی ہوجاتے ہیں۔لیکن اُن میں سے کسی نے کبھی اتنا بڑا سٹیپ لینے کی کوشش نہیں کی۔تو اس ہی لئے میں آپ کو بھی سمجھارہی ہوں کہ آپ ٹھنڈے دل و دماغ سے اس سارے معاملے کو دیکھیں۔آپ کے شوہر آ نہیں رہے لیکن میں کسی نہ کسی طرح سے ان کومصالحت کے لئے بلوالوں گی۔ زیبا:میں آپ کو بیٹا کہہ کر مخاطب کرسکتی ہوں ؟کیونکہ ابھی کورٹ میں نہیں بیٹھے اور آپ میرے بیٹے سے پانچ، چھے سال ہی بڑی ہوں گی۔ جج: جی زیبا:برا نہ منائیں تو یہ پوچھ سکتی ہوں کہ آپ کے والد صاحب کیا کرتے ہیں؟ جج:Lawyer ہیں۔اب بھی پریکٹس کرتے ہیں۔ زیبا:ماشااللہ۔کفالت کرتے ہیں نا آپ کی؟ کفالت کر کے آپ کی ذمہ داری اُٹھا کر آپ کو اس مقام پر لاکر بٹھایا ہے انہوں نے۔اور شاید آپ کی نئی نئی شادی بھی ہوئی ہے کیونکہ پچھلیhearingپر پتہ چلا تھا کہ شادی کی وجہ سے آپ چھٹی پر ہیں۔اس کے انتظامات ۔یہ جو بیٹا ہے نا میرا،یہ چھبیس سال کا ہے۔اور اس نے آج تک اپنے باپ کی کمائی کی کوئی ایک چیز استعمال نہیں کی ہے۔ڈبے کے پہلے دودھ سے لے کر پہلے ڈائپر تک، میرے ماں باپ کے گھر سے آتا تھا۔اور پھر وہ ذمہ دار ی میں نے اٹھا لی۔ بھی یقیناً آپ کے والد صاحب نے ہی کئے ہوں گے۔آپ نے کہا نا ابھی کہ صرف کفالت نہ کرپانا اتنی بڑی بنیاد نہیں۔بیٹا آپ کو پھر دین اور قانون دونوں کے بارے میں زیادہ پڑھنا چاہیے۔شادی کھڑی ہی کفالت کے عہد پر ہوتی ہے۔ستائیس سال اگر کسی عورت نے شکایت نہ کی ہو، تو اس کا نتیجہ یہ تو نہیں ہوسکتا کہ یہ کہا جائے کہ اگر ستائیس سال بغیر کفالت کے مرد کے ساتھ رہی ہے تو اب بھی رہتی رہے۔اور کوئی مر د اگر بدکردار نہیں ہوتا، تو اس کا یہ مطلب بھی نہیں ہے کہ اُس کی باقی ساری خرابیاں تکلیف دہ نہیں ہوسکتیں۔ایک شادی کو ناکام نہیں کرسکتیں۔اُس کا غیر ذمہ دار ہونا، اُس کابے حس ہونا، اُس کا خود غرض ہونا۔اُس کا لالچی ہونا۔ان ساری وجوہات سے بھی شادی ٹوٹ سکتی ہے۔اورآپ نے کہا نا کہ کوئی بنیاد ہی نہیں ہے۔کیا بنیاد دیتی؟ میں اپنے شوہر کی کون سی برائیاں کیس میں ڈال کر پوری دنیا کے سامنے، اپنے بچوں کے سامنے اُس کو ذلیل کر کے خلع مانگتی؟میں نے تو شرم کے مارے صرف وہی بنیاد آپ کے سامنے رکھی ہے جو دین رکھ کر باقی سب کو ڈھک دیتاہے اور آپ اُس کو بنیاد ہی نہیں مان رہیں۔کتنا مشکل ہے ایک عورت کے لئے خلع کے لئے کورٹ میں آنا۔کس کس نے نہیں روکا مجھے؟ماں نے،بھائی نے، بہن نے،محلہ داروں نے، رشتے داروں نے،سکول کےcolleagues نے۔جہاں میں رہتی تھی وہاں کے مسجد کے امام نے، جس دکان سے میں سبزی لیتی تھی اُس سبزی والے نے۔ایک ایک بندے نے پکڑ پکڑ کر مجھے بتایا ہے کہ ستائیس سال ہوگئے ہیں زیبا۔ستائیس سال بعد شادی ختم نہیں کرتے۔ستائیس سال بعدبس چپ کر کے جئے جاتے ہیں۔انگلی بھی نہیں اٹھاتے، زبان بھی نہیں ہلاتے۔کوئی حق بھی نہیں مانگتے۔بس سر جھکا کر سب کچھ سہتے جاتے ہیں۔کیونکہ مڈ ل ایج میں آجاتے ہیں نا اور آگے بڑھاپا کھڑاہے تو معاشرے کے سینئرcitizen ہوکر معزز ہونا ضروری ہوتاہے۔اور خلع لینے والی عورت معزز تھوڑی ہوتی ہے۔اپنے شوہر سے ستائیس سال بعد بھی کفالت کا مطالبہ کرنے والی عورت تو بری عورت ہوتی ہے۔اچھی عورت تو وہ ہوتی ہے جو کچھ نہ مانگے، بس جیے جائے۔تو بیٹا آپ کو ایک نصیحت ہے میری۔اگر کوئی مرد آپ کی شادی کے شروع میں آپ کی مالی ذمہ دار ی اٹھانے پر تیار نہیں ہے نا تو وہ وقت گزرنے کے ساتھ ساتھ آپ کی اور آپ کے بچوں کی ہر ذمہ داری اٹھانے کے لئے نا اہل ہوتا چلاجائے گا۔وہ بے حس ہوتا جائے گا۔غیر ذمہ دار ہوتاجائے گا۔وہ اپنا بوجھ آپ کے کندھوں پرڈالتا جائے گا۔اور ایک وقت آجائے گا کہ وہ بوجھ اٹھاتے اٹھاتے آپ کبڑ ے ہوجائیں گے۔تو آپ کو نصیحت ہے میری بیٹا!ایسی کوئی پریشانی کبھی آپ کو آئی خدانخواستہ تو آپ بہت شروع میں زندگی کا یہ بڑا فیصلہ کرلینا۔میری طرح ستائیس سال انتظار مت کرنا۔ورنہ پھر آپ بھی کسی اپنے سے آدھی عمر کی جج کے سامنے بیٹھی اُس کو سمجھارہی ہوں گی کہ ستائیس سال کے بعد بھی کفالت نہ کرنے کی بنیاد پر آپ ایک مرد سے الگ ہوسکتی ہیں۔ کفیل از عمیرہ احمد

My father has been under arrest for 845 days. For the past six weeks, he has been kept in solitary confinement in a death cell with zero transparency. His sisters have been denied every visit, even with clear court orders allowing access. There have been no phone calls, no meetings and no proof of life. Me and my brother have had no contact with our father. This absolute blackout is not a security protocol. It is a deliberate attempt to hide his condition and prevent our family from knowing whether he is safe. Let it be clear: the Pakistani government and its handlers will be held fully accountable legally, morally and internationally for my father’s safety and for every consequence of this inhumane isolation. "عاصم منیر کی جانب سے پاکستان میں "ہارڈ سٹیٹ" کا جو تصور فروغ دینے کی کوشش کی جا رہی ہے، وہ بالکل غلط ہے۔ ہارڈ سٹیٹ کا اصل مطلب ہے ایسی ریاست جہاں آئین کی بالادستی، قانون کی عملداری، عدل و انصاف کا نظام، اور جمہوری آزادی ہو، جہاں ذاتی مفاد نہیں بلکہ ملک و قوم کا مفاد مقدم ہو۔ جبکہ عاصم منیر کی "ہارڈ سٹیٹ" سے مراد ایسی ریاست ہے جہاں جمہوریت کے تمام ستونوں کو کچل کر "عاصم لاء" نافذ ہو۔ یاد رکھیں، عوام کی تائید اور حمایت کے بغیر کسی بھی ملک میں کسی “ہارڈ سٹیٹ” کا قیام ناممکن ہے۔ جو مظالم عاصم لاء کے تحت ڈھائے جا رہے ہیں، ان سے ریاست "ہارڈ" نہیں بلکہ اس کی جڑیں مزید کمزور ہو رہی ہیں۔ 26 نومبر اور مریدکے کی طرح اپنی ہی فوج، رینجرز اور پولیس کے ذریعے اپنی ہی عوام پر گولیاں برسانے سے کوئی ریاست مضبوط نہیں ہو سکتی۔ خیبرپختونخوا کے عوام نے تحریکِ انصاف کو بھرپور مینڈیٹ دیا ہے۔ اس مینڈیٹ کے تحت یہ میرا آئینی اور جمہوری حق ہے کہ صوبے کی پالیسیاں خود مرتب کروں، کیونکہ میں براہِ راست عوام کو جوابدہ ہوں۔ وزیرِاعلیٰ خیبرپختونخوا سہیل آفریدی کا بھی یہ حق ہے کہ وہ میرے ساتھ مشاورت سے صوبے میں ان پالیسیوں کا نفاذ یقینی بنائیں، جن کے لیے عوام نے ہم پر اعتماد کر کے ہمیں ووٹ دیا ہے۔ تحریکِ انصاف کے دور حکومت میں بہتر پالیسیوں کے باعث خیبرپختونخوا سمیت ملک بھر میں امن قائم ہوا، مگر رجیم چینج کے بعد سے حالات مسلسل بگڑتے جا رہے ہیں۔ میں تین سال سے مسلسل کہتا آیا ہوں کہ ہمیں دانشمندی اور دوراندیشی کا مظاہرہ کرتے ہوئے افغانستان کے ساتھ پرامن انداز میں معاملات آگے بڑھانے چاہییں۔ افغانستان سے کشیدہ صورتحال نہایت تشویشناک ہے۔ نفرت اور تصادم کسی کے مفاد میں نہیں، عوام کے حقیقی نمائندوں کی بنائی ہوئی پالیسیاں ہی دہشتگردی کا دیرپا حل نکال سکتی ہیں۔ میرے خلاف قائم جھوٹے اور بے بنیاد مقدمات کو جان بوجھ کر لٹکایا جا رہا ہے۔ القادر ٹرسٹ کیس میں گزشتہ دس ماہ سے انصاف کا قتل ہو رہا ہے۔ مشکل سے 10 ماہ بعد کیس کی سماعت کی تاریخ ملی، مگر ضمانت کا فیصلہ تاحال تاخیر کا شکار ہے۔ میں تحریکِ انصاف کے تمام سیاسی قائدین، اراکینِ اسمبلی، اور وکلاء کو ہدایت دیتا ہوں کہ اب سے میرے تمام کیسز کی عدالتی کارروائیوں میں باقاعدگی سے شرکت کریں، سماعت کے موقع پر عدالت میں موجود رہیں، اور انصاف کے حصول تک اپنی موجودگی برقرار رکھیں۔ اوپن کورٹ کے کیسز میں شرکت آپ کا قانونی و جمہوری حق ہے۔ تحریکِ انصاف کے دورِ حکومت میں نواز شریف کو جیل میں روزانہ کثیر تعداد میں سیاسی رہنماؤں سے ملاقات کی اجازت تھی، فیملی کو بلا روک ٹوک رسائی حاصل تھی، بلکہ جیل میں دعوتوں تک کا اہتمام کیا جاتا تھا۔ اس کے برعکس آج مجھے مکمل تنہائی میں رکھا گیا ہے۔ اس سے بڑی سیاسی انتقام کی مثال پاکستان کی تاریخ میں نہیں ملتی۔ مجھے جیل مینول کے مطابق بنیادی سہولیات فراہم نہیں کی جا رہیں۔ پچھلے دس مہینوں میں صرف ایک بار میرے بیٹوں سے بات کروائی گئی، وہ بھی تین تین منٹ کے دو مختصر وقفوں سے۔ مجھے ناصرف بنیادی انسانی حقوق سے محروم رکھا جا رہا ہے بلکہ بطور پارٹی لیڈر، اپنے سیاسی ورکرز سے ملاقات کی اجازت بھی نہیں دی جا رہی۔ وکلاء، سیاسی رفقاء اور اہلِ خانہ سے ملاقات میں بھی مسلسل رکاوٹیں ڈالی جا رہی ہیں۔ یہ سراسر بنیادی اور قانونی حقوق کی خلاف ورزی ہے” سابق وزیراعظم عمران خان کا بہنوں اور وکلأ کے ذریعے اڈیالہ جیل سے پیغام (21 اکتوبر، 2025)

“The concept of a ‘hard state’ that Asim Munir is attempting to implement in Pakistan is entirely misguided. In its true sense, a “hard state” is one where the Constitution reigns supreme, justice remains independent, democratic freedoms are protected, and the national interest outweighs personal gain. In contrast, Asim Munir’s notion of a ‘hard state’ signifies a system in which the pillars of democracy are dismantled and ‘Asim Law’ prevails. No ‘hard state’ can ever be established without the support and will of the people. The atrocities being perpetrated under ‘Asim Law’ are not strengthening the state. They are, in fact, eroding its very foundations. No country can become strong by turning its guns on its own citizens, as witnessed on November 26th (2024) and in Muridke, where the army, paramilitary Rangers, and the police opened fire on their own people. The people of Khyber Pakhtunkhwa have given a clear and overwhelming mandate to Pakistan Tehreek-e-Insaf. This mandate grants me the constitutional and democratic authority to determine the province’s policies, for my accountability lies solely with the people. It is also the right of the Chief Minister of Khyber Pakhtunkhwa, Sohail Afridi, to ensure the implementation of the policies, formulated in consultation with me, for which the people reposed their trust and cast their votes in our favor. During PTI’s tenure, prudent policies fostered peace across Khyber Pakhtunkhwa and beyond. Yet, since the regime change, the nation has witnessed a consistent deterioration in stability. Over the past three years, I have consistently emphasized the need for wisdom and foresight in dealing with Afghanistan through peaceful means. The current strained relations with Afghanistan are deeply concerning. Hatred and confrontation serve no one’s interests; only policies framed by genuine representatives of the people can bring about a lasting solution to terrorism. The baseless and fabricated cases against me are being deliberately prolonged. In the Al-Qadir University Trust case, justice has been systematically denied for the past ten months. After an extended delay, the case was finally scheduled for hearing, yet the decision on bail continues to be postponed. I instruct all PTI political leaders, members of assemblies, and lawyers to regularly attend and remain present during all court proceedings of my cases, and to continue their presence until justice is served. Participation in open-court hearings is your legal and democratic right. During PTI’s tenure in government, Nawaz Sharif was allowed daily meetings with numerous political figures in jail, with unrestricted access to family members. Even formal dinners were arranged. In stark contrast, I am being held in complete isolation. There is no precedent for such political vendetta in Pakistan’s history. I am not being provided the basic facilities guaranteed under prison regulations. Over the past ten months, I have been allowed to speak to my sons only once, and that too for two brief intervals of three minutes each. I am being deprived not only of my fundamental human rights but also of my rights as the head of a political party, to meet party officials and consult with them. Hurdles are constantly placed to obstruct my meetings with lawyers, political colleagues, and family members.
