Recently the Appointment Committee of the Cabinet has approved the appointment of an All India service officer of IAS cadre of 2010 batch to a post of Joint Secretary which is in Pay level 14 ie starting basic pay of 144200/- Now in Apr 2028 all officers of 2010 batch of other AIS and all GP A Services and CAPF will move to the pay level 14. Whereas in the Forces , 2010 batch only those selected as Colonel and getting promoted to the rank will be now moving into pay scale of 13 ie starting 125700/- and in 2028 with 18 years of service their basic will remain 133400/- Rest of the batch as Lt Col will remain in 2028 at Pay level 12 A at basic of 131300/- This is the great disparity in BASIC PAY . So Defence officers first get blasted by a BurzKhalifa promotion avenue and then fried by this NO NFU . Historically Basic Pay at commissoning of a 2/ Lt has been more than that of a probationer joining the Civil services including IAS cadre . So there has to be NFU parity between Armed Forces and IAS ....this game tamasha to deby the NFU boils down to this parity and nithing else . Coming to the affidavit filed by Bureaucrats on behalf of Govt of India which is the CABINET , saying that NFU is not being granted because of lack of funds is simply great . First, what is NFU? NFU means Non Functional Upgradation. In simple words, when an IAS officer of a batch moves to a higher level, officers of other eligible services from the same batch can get the higher pay level without actually holding that post. It was created after the 6th Pay Commission to address stagnation and pay gaps. That is exactly where the absurdity begins. The Army has one of the sharpest pyramids in Government. Everyone cannot become Brigadier, Major General or Lt General because command appointments are limited by structure. The Armed Forces Tribunal itself noted that stagnation in the defence forces is among the highest, and that NFU is linked to stagnation, not to functional command. Yet armed forces officers were left out, while IPS, IFS and 49 Group A services moved ahead. The AFT said this exclusion pushed defence officers far behind their civilian counterparts in career progression, status and morale. That is the heart of the anger. Same nation. Same sovereign service. Very different treatment. Who is fighting this case? Not the Army as an institution in any aggressive public sense. The litigation has been led mainly by officers like Col Mukul Dev and similarly placed officers. The AFT ruled in 2016 that the denial of NFU to the defence forces was “unfair, evasive and without valid justification” and directed that it be extended to all similarly placed officers of the Army, Navy and Air Force. What is the Government’s line? As per government armed forces are different, they are not Organised Group A services, NFU could disturb command structure, and there are legal and financial hurdles. That sounds neat on file. But it collapses on logic. Because pay upgradation is not the same thing as command promotion. A Colonel getting fairer pay does not suddenly become a General in command. In fact, the AFT explicitly said the classification used to deny NFU was unsustainable and had no nexus with the real object of NFU, which is to reduce stagnation. It also recorded that the respondents had not argued against NFU on financial constraints in that case. That makes today’s official logic look even weaker. The real issue seems obvious. Bureaucratic parity is protected when it benefits bureaucracy. But when military officers ask for the same financial protection against stagnation, suddenly “structure”, “classification” and “uniqueness” are invoked. That is why so many officers see this not as a pay dispute, but as an issue of institutional respect. The cleanest solution is also the most sensible one Delink rank from pay level after a point. Let rank decide command, authority and appointments. Let pay progression reflect length of service and stagnation. You cannot promote an entire course to Major General. But you can stop financially punishing officers just because vacancies do not exist above them. This preserves hierarchy and restores fairness. This is an inference from how NFU is designed and from the tribunal’s finding that NFU addresses stagnation rather than command. This is why the NFU fight refuses to die. It is not greed. It is not entitlement. It is a demand that if the State accepts stagnation relief for the civilian system, it cannot deny the same principle to the men it expects to serve, sacrifice and retire earlier under a far steeper pyramid.
