📅📢Day 02 Highlights: Key issues coming out from the intensive training on Enhancing Mining Contract Drafting Skills for @AGZim_Official and @ParliamentZim legal office. 1⃣The Attorney General plays a key role in advising Government on stabilization clauses especially in mining contracts. This is important to ensure that Government in not shortchanged in the long-term through international commodity fluctuations. 2⃣ The Attorney General should endeavour to draft Statutory instruments that are holistic and embrace ESG principles. For example, SI 188 of 2024 on the ban of Alluvial Mining focuses on environmental protection, yet it can be reviewed to include social and governance issues. 3⃣The Government should consider various options to make CSR effective which include: (a) legislate through SI or Mines Act (b) Review the governance of CSOTs through the proposed Empower Bill (c) Ensure Royalties collected by Government are ring-fenced and channelled to local communities through local authorities. (d) Or leave it voluntary 4⃣ Parliament and ZIDA should regularly share information on SIs that contradict each other or violate existing contracts to protect the sanctity of contracts and promote legal certainty on the investment environment in Zimbabwe. 5⃣The Attorney General should encourage the sponsoring line Ministry or Government Agency to come up with the first draft contract as this makes it easier to negotiate for a contract that's in the best interest of the country. 6⃣The Attorney General's office should advise Government entities to include provisions on ESG principles in contracts which are feasible and practicable. 7⃣ The Attorney General should advise public entities in triple PPP agreements to ensure that the project or service meets the interests of both the Government and investor as well as ensuring it is affordable and beneficial to citizens. #SustainableDevelopment #ESG #Zimbabwe #CriticalMinerals @fadzyMislee @iamkudadube @ShamisoMtisi @PatienceRashai @Obertbore @jnyamukunda @lawsocietyofzim @MinistryMines @euinzim @SwedeninZW @PWYPZIM @PWYPtweets @UNDPZimbabwe @ActionAidZim @CNRG_ZIM @CAID_Zimbabwe @NPAZim @zidainvest
