Should the taxpayer still bear the burden of proof in instances where a tax dispute with the Revenue Authority is based in pre-populated & third party data? In my submission before the National Assembly's Finance & Planning Committee on behalf of the Tax Research Centre at @StrathU, I argue that Finance Bill 2026's proposals seeking to anchor Incomes & Expenses Validation in law will be incomplete if they do not include a proposal for the the Revenue Authority being saddled with the burden of proof in such instances. Here's why: · Finance Bill 2026 proposes to amend Sec75 of the Tax Procedures Act to provide that the Revenue Authority may use technology to pre-populate tax returns on behalf of a person required to submit or lodge a tax return · Finance Bill 2026 further proposes that a person required to submit or lodge a tax return may rely on pre-populated return generated by the Revenue Authority to file their return · Finance Bill 2026 proposes to amend Sec112 to provide that the Cabinet Secretary of the National Treasury may make Regulations for the procedure for the submission or lodging of returns based on pre-populated tax returns generated by the Revenue Authority Here's where the problem is: · In all this, Sec56(1) which provides that "In any proceedings, the burden shall be on the taxpayer to prove that a tax decision is incorrect" remains unchanged · Sec56(1) is predicated on the fact that Kenya has been running on a self-assessment based regime & the data upon which tax disputes emerges was held by the taxpayer · With Incomes & Expenses Validation & the onset of a Dual Assessment regime in Kenya, taxpayers are now exposed not just to errors of judgement & data on their part, but also errors of technology & transmission which are out of their control · Can we really still have the burden of proof lying exclusively with the taxpayer in an environment where tax compliance has shifted from a function of record keeping to one where system integration reliability is now a key factor?

. @KRACorporate wants the right to make prosecution of tax audits the responsibility of citizens. Besides being unconstitutional, tax work is what KRA people are paid to do 8 to 5. Citizens are busy working to raise income from which to pay taxes. Tax work is not our 8 to 5. We shouldn't be punished for not doing KRAs work the way KRA would do it. We are not KRA.

Kenyans have recently witnessed brazen boasts about stealing elections and naked threats against citizens who dissent with certain political views. This trend indicates a disturbing pattern of the ruling elite growing increasingly intolerant with the very people it was elected to serve. The Constitution of Kenya is unambiguous. Every citizen has the right to free expression, to assemble, to vote, and to have that vote count. Any public officer who works to subvert those rights, whether through deed or through reckless public utterance that normalizes electoral fraud, is in breach of their oath of office. The @IEBCKenya and the @NCIC_Kenya have both the mandate and the tools to respond to exactly this kind of provocation. What Kenyans need is for these tools to be converted into visible action against those who openly undermine the electoral process. The NCIC has acted swiftly in the past against inflammatory speech, and there is no reason it cannot do so now. The IEBC, newly reconstituted and with an opportunity to rebuild public confidence, has much to gain by demonstrating decisiveness at this early stage. Both institutions should see this moment as a chance to assert their independence and show Kenyans that the safeguards built into the Constitution are real and enforceable. Elections in Kenya are not an abstract civic exercise. They are deeply emotive, freighted with memory, grievance and hope. When politicians openly boast about rigging and institutions do not visibly respond, the result is a citizenry that grows more cynical with each passing election cycle, a deepening trust deficit that drives voter apathy, and a democracy that hollows out quietly from within. Kenya stands at a consequential moment. The country has come too far, paid too high a price in blood and grief and hard-won constitutional reform, to allow our democratic space be dragged back toward the darkness of disputed elections and ethnic mobilisation. The institutions built to prevent exactly that must now rise to the occasion.

Please join me in demanding justice for Prudence Imali. I’ve just watched an NTV report about Prudence Imali, a woman who was allegedly shot by police during the matatu strike. What hurts the most is that she was not even part of the protests. She had simply left her child at home and rushed to a nearby shop to buy something. While returning home, she was allegedly shot. A child waited for their mother to come back home, but she never did. Now reports say police have refused to release the OB, delaying the postmortem and denying the family answers. This is the part that should disturb every Kenyan: Today it is Prudence Imali. Tomorrow it could be your sister, your mother, your wife, your friend, or anyone innocently walking home. How many innocent lives must be lost before accountability matters? Please raise your voice. Please speak out. Please demand justice. Justice for Prudence Imali.

New Yorkers shouldn’t have to worry every time it rains. Ahead of this weekend’s storms, City workers have been out across all five boroughs clearing and inspecting catch basins in flood-prone neighborhoods. Today I joined @NYCWater in Bushwick to clear a catch basin overflowing with debris and litter on Knickerbocker Avenue, one of the areas hit hardest by Wednesday’s storm. If you see a clogged catch basin, call 311. And if you’re able, help your neighbors by clearing leaves or litter from nearby grates before the rain arrives.
