In the 11th Circuit a white law partner can tell her black assistant "Lincoln may have freed the slaves, but I'm keeping you" in front of a coworker because "occasional off-color comments" (no pun intended) do not constitute a hostile work environment. 12b6 dismissal.

@DouthatNYT “Competitive authoritarianism” is also defined by the checks that opposition has on the state, at least per the political theorists behind the term. You’re right that just bending rules to stay in power isn’t enough- it requires some kind of sway by the perennial opposition.

The results in Hungary tend to confirm one of my strongly-held views, which is that terms like "illiberal democracy" can be usefully descriptive but the phrase "competitive authoritarianism" is just a contradiction in terms. x.com/zackbeauchamp/…
Zack Beauchamp@zackbeauchamp

Hungary under Orbán was not a classic fascist or monarchical regime. It was a species of what political scientists call "competitive authoritarianism" — where elections are generally free, meaning not formally rigged, but held under extremely unfair conditions.

@SellersCounsel @REdebtlawyer I’m not sure how old you both are, but I’m a third year. The unpredictability of assignments is what makes us miss things, not the number of hours worked. Sometimes things just come up and it’s our job to assist. Not a lot of discretion for flexibility there.

@REdebtlawyer Also from an associate standpoint I think it depends a lot on your dependability. If the partner knows they can depend on you they’re going to give you flexibility. But if you’re constantly missing deadlines they’re going to treat everything as a fire drill

I know several small firm owners that never go to their kids sporting events or birthday parties. Meanwhile, the most successful BigLaw partner I know doesn’t miss any of his daughter’s volleyball games or life events for children of his associates. I talked to a BigLaw associate yesterday who billed 2300 hours last year but ate dinner with his family and put his kids to be every night. Those who want to make it work will find a way to make it work.

@jwreischel @boilerroom481 @jonfavs I’m not sure if you’re responding to my points, or my own views on asylum generally. If the former: many Americans clearly agree with you. But people were legally allowed to pass through countries and seek asylum. There’s no law against it so they’re not here illegally, right?

@boilerroom481 @jonfavs Alright I think we can agree, then. I’m against Vance’s position here because I believe in a robust, very legalist asylum. However, if “my side” used bad faith, effective demagoguery, I’d be fine with it.

@___nabob___ @jonfavs Fine, but Vance is playing a game where he is forcing prominent Dem voices to back those who came here under specious claims of asylum, which we know from 2024 election is a very unpopular position with the masses.

@boilerroom481 @jonfavs I’m not disagreeing with you, it’s just irrelevant They followed the law as written so the “illegal” label used by Vance is wrong. That’s @jonfavs point. You/admin have every right to believe their claim is specious. But they’re not “illegals” until that’s determined

@___nabob___ @jonfavs I think most people would say that they shouldn’t have traveled here under a very specious claim of asylum, and certainly shouldn’t be allowed to his stay in the country indefinitely while that claim is decided. That position would poll very well

@boilerroom481 @jonfavs How does your position matter here at all? It’s the asylum seeker’s job to follow whatever law is in place, which you’re admitting they did. What else were they supposed to do?

@jonfavs I think the American people overwhelmingly reject the idea that anyone can come here and claim asylum no matter how specious. You may be right on the law but that’s not where public sentiment is on this

@dyingscribe I’m not a huge Sanderson fan, but you can’t discount how prolific he is. It’s a legitimate skill to write this much. People are invested in characters they spend a lot of time with.

I don’t understand how Sanderson’s work is so popular when his actual prose and character work might as well be cardboard The man would be great if writing tabletop RPG’s was lucrative, considering his work with systems and the design of them, but his actual writing? I don’t understand the appeal that people see in it

@lobgamistos @wildstwawberry What’s wrong with “totem” ? Using non-white mythological terms doesn’t suggest (to me) that a people are superstitious. “Tribal” has negative connotations and was misused so I understand that more. It’s like not using “crusade,” but more salient.

Trailer is great but let’s look deeper into this thing -Odd Netflix inspired design work (ugly) -Zendaya as Athena and Tom holland -Ellen Paige will play a man -Nolan’s historical philosophy is not up to par, let’s say compared to Eggers This will do extremely well, it will largely appeal to people who love Nolan and Batman. It’s just not made for lovers of Western canon, history, literature, philosophy. It’s made for the modern audience. I received 2 death threats for criticizing a helmet so that tells you where we are

@Awk20000 He obviously got lucky and stumbled on this, but he’s right. There are tons of niche luxury goods (Pokémon/MtG cards, Birkin bags, Eras Tour tickets) that outperform the stock market. It has always been true, but no one has an arbitrage theory to support it as an asset class

The historical evidence in favor of the Trump Administration's birthright citizenship order is strong. My forthcoming law review article bolsters that evidence - and helps show just how weak the arguments are for "universal" birthright citizenship. jlcgtamu.com/wp-content/upl…

@ASFleischman The claim that they should have provided coverage gets proven, there are even class actions about specific policies leading to denials. Some of those people die, but I agree that saying “they would have lived but for the denial” is usually conjecture
