@OJEN_ROEJ The more people there are the more the information can be tampered. It’s like a game of telephone (iykyk). After going through 1000000 people that information has most likely been lost in translation effecting the quality of that legal information. Fake news is a great example!

#OJENROEJFA22 So there's obviously a quantitative difference between 100 people watching a thing and 1000000 people accessing it: but is there also a QUALITATIVE difference?🤷‍♂️

@hscpolitics2022 Having limited amounts of seating is beneficial - too many people viewing the trial online can make the victim vulnerable and affect due process as per sec. 136(1) of the Court of Justice Act. @OJEN_ROEJ @NDHSLawTO @NDHSbeach

@NDHSLawTO @OJEN_ROEJ @NDHSbeach So from what you’re saying is media can be in the courtroom, but the footage should be released at the final verdict to ensure a fair trial?

With camera's in the courtroom, judges, juries and witness can be influenced throughout the process. The only exception would be as in R. v. Vader where they televised a verdict at the conclusion of the murder trial. @OJEN_ROEJ @NDHSLawTO @NDHSbeach #OJENROEJFA22

@Emilyloveslaw @OJEN_ROEJ Court documents are not always public. Justices are allowed to seal these records. The issue with live broadcasting is “innocent until proven guilty” would no longer exists due to mass media companies spinning the information. It now becomes guilty until proven innocent. Unjust!

#OJENROEJFA22 @OJEN_ROEJ I believe live broadcasting should be permitted in Canadian courtrooms because they are already open to the public and all court documents are public record anyways.

@sdcilaw @OJEN_ROEJ @ProvostLaw I don’t think you have the right to see victims be tortured when tapes are brought in as eveidence. Your intentions with your rights are slightly questionable

Public opinion is at the forefront of violating s. 11(d), “any person charged with an offence has the right to be presumed innocent until proven guilty”. By having a live broadcast, public opinion could favour @OJEN_ROEJ @ProvostLaw #OJENROEJFA22

#OJENROEJFA22 Interesting point here - if it's in the public interest, should private broadcasters be permitted to sell it for profit?
Sawyerfanclub@Sawyerfanclub1

@julian38257457 @ProvostLaw @OJEN_ROEJ Also you have to consider the fact that in the states you need a specific channel to watch these trials. So do you think it’s right to make business out of others misery? Tell me your thoughts🫶🏼 2/2

@OJEN_ROEJ @ProvostLaw #OJENROEJFA22 I have a question for everyone. People are saying we need cameras for transparency to trust the justice system. Is this putting transparency above the protection of innocence? Wouldn’t we be losing trust when they wrongfully convict anyways?

@lawclass328 @OJEN_ROEJ The transparency can be seen in other sectors of media. For example case briefs But we need to protect the innocence of people Would you rather someone be wrongfully convicted and lose years of life: David Milgaard or have trust, something that’s broken by wrongful convictions

#OJENROEJFA22 Cameras in the courtroom provide transparency and accountability for the justice system. It helps people trust that the right course of action is being taken. We need to make sure it doesn't become entertainment though. #OJENROEJFA22 @OJEN_ROEJ

#OJENROEJFA22 this tweet's so nice we're retweeting it twice :P Let's start a list of hypothetical civil cases and areas of law that would have broad social significance. We'll start: - Corporate polluters
Breanna Dunmore@_breadunmore_

@OJEN_ROEJ The only civil matters that concern all of society would be big corporations. But that doesn’t need to be broadcasted because the only piece that matters to the public is the final remedy. Broadcasting civil disputes isn’t as dramatic as society wants it.

@STFlawclub @OJEN_ROEJ That’s a fair point but that’s a recording which is again illegal and we are debating a live broadcast. It makes sense to review footage to set future precedents but to use this broadcast as future evidence I. The trial is unfair🥰

Rather than causing more people to commit perjury, would it allow the spectators and jury to look back at the trial and analyze the body language (something we don't have access to on a written text) giving a more definite tone to what was said. @OJEN_ROEJ #OJENROEJFA22
Breanna Dunmore@_breadunmore_

@LoyolaLaw_HCDSB @OJEN_ROEJ Is it fair to say a public trial in general would stress out witnesses and juror because they’re in the eyes of the public? And that stress could cause lying/perjury?

#OJENROEJFA22 We were intentionally vague to provoke this precise question! Let's think about some of the similarities and differences: Can the public have an interest in a civil matter? Are all civil matters between private individuals? Should the law distinguish civil/crim?
Loyola Law Students (HCDSB)@LoyolaLaw_HCDSB

@OJEN_ROEJ Many of my grade 12 students asked this question - is the proposal based on criminal or civil trials? At the end of the day, you have the right to an impartial judge and/or jury in both criminal and civil matters.

The Canadian law should not permit live broadcasting of trials because it violates the privacy of the people in the court. Although live broadcasting of trials can be informative to the public or even entertaining like the Jonny Depp and Amber Heard trials, in the long run,

@lawclass328 @CPSSLaw2022 @OJEN_ROEJ Personally I don't think whether they understand their actions or not is a reason they should be broadcasted. Many serial killers don't understand the impact of their actions during the trial. We should have respect for the victims families, don't turn THEIR life into a new drama

The Youth Criminal Justice Act protects the privacy of young people who are accused or found guilty of a crime by maintaining the secrecy of their identity and other personal information. Exactly, how do live broadcasting trials align with this act, then? #OJENROEJFA22 @OJEN_ROEJ
