Figures show that the Scottish government spent £157,816 defending guidance which stated that biological men with a gender recognition certificate (GRC) were women, which was eventually ruled unlawful by the Supreme Court. This is in addition to the £216,182 in public cash that it spent on an earlier legal case, which resulted in a previous version of the guidelines — which said anyone who identified as a woman was counted as one — struck down by the Scottish courts. For Women Scotland, the campaign group which brought the legal challenges, is expected to recoup about £250,000 of £417,000 it spent on the latest case in costs, bringing the likely total cost to the public purse to £624,000. “We hope that the mounting costs of legal cases will cause the government to reflect that they should listen to experts rather than activists in the future before risking public money,” Susan Smith, a director at For Woman Scotland, said. “Currently, unlawful guidance is still being used across the public sector in Scotland, including in schools, hospitals and the prison service. Some of this bears the imprimatur of the Scottish government. “We would urge them to withdraw all unlawful guidance and direct public bodies to follow the Supreme Court ruling. Delays will only make more legal claims inevitable.” The Scottish government has said it accepted the ruling of the Supreme Court, which found that for the purposes of UK equalities law, “sex” is a biological category. The regulator has already issued an interim update saying trans women — biological men who identify as women — should not be able to use female single-sex facilities. However, bodies such as the Scottish NHS, schools and the Scottish government are still operating self-ID policies. “It will rightly stick in the throat of taxpayers that they are picking up a huge legal tab for the SNP’s needless and humiliating court defeat,” Tess White, equalities spokeswoman for the Scottish Conservatives, said. “They dug their heels in defending the indefensible to the highest court in the land, instead of accepting that gender self-ID was a dangerous fallacy that ignored the legal rights of women and girls. “Yet, even now, John Swinney won’t apologise or issue a new directive to public sector bodies — which adopted self-ID wholesale — on their legal requirement to protect single-sex spaces. 🚨STATEMENT: With the FSU’s backing, Lucy Connolly, jailed for a tweet about migrants that she posted following the Southport murders, has been fighting her 31-month sentence in the Court of Appeal. Although a verdict was expected on Thursday when the hearing concluded, the Court will now be providing a written judgement, somewhat vaguely scheduled for “as soon as possible”. We paid for top-drawer legal representation for Lucy — and would like to thank barrister Adam King for all he’s done. Lucy — a childminder and Conservative councillor’s wife — received the sentence in October after pleading guilty to inciting racial hatred. The charge related to an outburst on X just hours after the girls were stabbed to death: “Mass deportation now, set fire to all the f****** hotels full of the b******* for all I care, while you’re at it take the treacherous government and politicians with them. I feel physically sick knowing what these families will now have to endure. If that makes me racist, so be it.” The unpleasant nature of the tweet has never been in dispute. The sentence, however, has. After all, it exceeded that of some people convicted of actual violence in response to the murders. Philip Prescott, for example, was part of an attack on a mosque during which he threw missiles at the police. The judge found his offence was “clearly racially or religiously motivated disorder” — and gave him 28 months. But Lucy’s appeal wasn’t just on the grounds that her trial judge erred in assessing the offence’s severity. It was also that he failed to give enough weight to mitigating factors. Adam argued that her emotional reaction to what happened in Southport must be understood in light of her 19 month-old son’s death following a hospital mistake, and the psychiatric difficulties that resulted. He also pointed to the fact that, having had time to reflect, she removed the post within hours. For the FSU, Lucy’s case highlights the importance of ensuring that sentencing decisions are governed by law and principle rather than online outrage and public pressure — which is why members of our team were present at the Royal Courts of Justice throughout the appeal. They do not have the capacity or understanding of the world to know their place in it. That infant chatter might fit with the ideology of gender extremists, or the desire of certain parents for attention, does not make it any more meaningful. Yet the NHS has decided to water down its guidance in order to “treat” nursery-age children who believe, or have been taught to believe, that they are transgender. The previous minimum age of seven – in itself far too young – has been scrapped in response to what a source describes as “pressure” from trans activists, opening up children of nursery age to counselling and therapy.  The original guidance, published in 2023, was clearly correct when it stated that “an interest in clothes or toys of the opposite sex… is reasonably common behaviour in childhood”. Why, then, has it been altered? The numbers involved at the moment are small, with fewer than ten nursery aged children referred to gender clinics. When the “treatment” can set a child on a pathway to medical intervention and potential sterilisation, however, any number greater than zero is a clear scandal. The prospect that dozens of children under the minimum age of seven may have been referred is no less worrying.
