Why we need a new federal and state compact on AI. See link below. Here I argue that full bore federal preemption of State law is bad policy and legally suspect. But I point to a better way in which the federal government government does have hegemony (e.g. defense, Bioweapons, cybersecurity) and some topics where states keep jurisdiction like traditional negligence and fraud. Finding the right balance on AI regulation requires more than bumper sticker level political posturing. Rather Congress and the States need to do the hard work of fact finding, listening, learning and legislating in the daylight. I hope you enjoy this piece. theregreview.org/2026/01/12/bei… America faces two critical AI policy questions: Should federal regulation preempt state laws? And how do we govern the massive data centers powering AI expansion? The answer requires rejecting false choices. We can lead in AI development while maintaining strong safeguards—but not through executive overreach or industry self-regulation. Presidential executive orders cannot legally nullify state laws without explicit congressional authorization. States possess constitutional police powers over public safety, consumer protection, electricity rates, and water usage. With trillions in data center investment planned, we need state expertise managing local grid impacts, water supplies, and community effects—experience states like Virginia have already demonstrated. The federal government should lead on national security, cybersecurity, and safety standards for large AI systems. California’s SB 53 offers a model: legally binding checkpoints less burdensome than European rules, focused on high-risk systems. Congress must enact comprehensive legislation through open hearings and public deliberation, not backroom deals. This preserves democratic governance while keeping America competitive. AI will transform society. Whether it serves broad public interests or narrow corporate gains depends on governance choices we make now. We have one chance to get this right.

@ASlavitt Terrific book. A narrative of hope, frustration, and serious “preventable” errors on COVID. Andy’s prescription for policy changes —Plan N as in Never — in the Appendix may seem idealistic, unless you read this book. He puts you ‘in the room where it happened’.

@TomBollyky I very appreciate appreciate the triage arguments for 1 dose but I have two concerns. When there is insufficient evidence to support it could adversely affect vaccine confidence. We built a public health infrastructure at the FDA, CDC and NIH we should not undermine them.
