Go ahead.” News reporter: “This is in regard to Ms. McGauley’s home at (address) you contracted to buy for $95,000. Her attorney reached out to us at AJC stating that you wouldn’t let her out of the contract when she decided she no longer wanted to sell. Would you like to comment on that accusation?” Me: “Yes, that’s correct. I met Ms. McGauley at her home, explained how the process would be selling her home to us. She then breached the contract stating “she no longer wanted to sell.” Sellers can’t just choose one day to back out of a sale after signing a contract.” AJC ran the story with headline: “‘We Buy Houses’: investors target seniors with below market offers.” Thankfully the reporter included my comment in the article, so anyone with half a brain and not biased against investors could see who was in the right vs the wrong. We filed a specific performance suit. Seller fraudulently filed bankruptcy to make things more difficult. Instead of fighting through the bankruptcy, I decided to drop the suit and settle for a fee slightly above my attorney’s fees up, which was paid back to me over a few years. If you do enough deals in this business, eventually someone will try to paint you as the bad guy. Just make sure you’re doing things the right way and you have nothing to worry about.
