Why NYT has OpenAI by the ____s. ➡️ What every plaintiff’s lawyer wants is a defendant with really deep pockets that has behaved egregiously even after being giving a chance to fix the problem. ➡️ That’s when punitive damages are huge. ➡️ OpenAI will likely try hard to settle the case, but NYT feels genuinely threatened. ➡️ But OpenAI can’t afford to settle many similar cases for big bucks when they aren’t even turning a profit. ➡️ And they really can’t afford to lose. ➡️ NYT knows all this.
