No big rulings from SCOTUS today. But excellent and (with caveats) unanimous 2nd Amendment decision holding it's unconstitutional to bar marijuana users from owning guns (complete with rare Alito/Kagan concurrence). Great result, though I still don't like Bruen framework. May say more later: supremecourt.gov/opinions/25pdf…

@jimmy_esq If I'm not mistaken, that is the same authority they invoked in their COVID decision too.

The merits are obviously interesting and important here, but it's also a very neat case to illustrate the diversity of state-level judicial powers. Here, the PA S.Ct. asserts a longstanding "King's Bench" authority that is totally foreign to federal courts. Cool stuff!

@DaveSunday_ This is pretty crazy: The 5-2 Democrat Court finds Larry Krasner is so quick to falsely concede error in murder cases (to try to free convicted murderers) that it has tasked the Pennsylvania Attorney General with checking to make sure he's not lying. I've *never* seen this

@MorosKostas Isn't it also mild progress that they filed a concurrence and not a dissent?

Interesting that Kagan did not join the Jackson/Sotomayor dissent that calls for overturning Bruen and moving back to tiered scrutiny. Also, for those on Overton Window watch: Jackson and Sotomayor not calling to overturn Heller or questioning the core individual right to possess firearms.

In his concurrence in Hemani today, Justice Thomas suggested that the entirety of 18 U.S. 922(g) is unconstitutional. Over 33 MILLION PEOPLE are banned from using guns under this law. Do they deserve their rights back?

BREAKING: A 5-4 Supreme Court *upholds* an obscure doctrine that bars federal courts from reviewing challenges to state court rulings that aren’t final decisions from the state’s highest court. #SCOTUS Justices Roberts, Kagan, Gorsuch & Barrett dissent. supremecourt.gov/opinions/25pdf…

🚨 The Supreme Court ruled that the federal ban on firearm possession by unlawful drug users violates the Second Amendment as applied to a Texas man who regularly used marijuana.

🚨BREAKING: The Supreme Court Has STRUCK DOWN a Gun Ban on Marijuana Users. In United States v. Hemani, the Supreme Court ruled 7-2 that the federal govt cannot automatically disarm someone solely for regular marijuana use under Title 18. This is a huge, unexpected win for 2A.

Despite the Supreme Court’s 8-1 decision in Chiles v. Salazar, Oregon fined Catholic counselor Frank Canepa nearly $90,000 for declining to affirm a viewpoint that violated his faith. Why are so many progressive states treating Supreme Court precedent as optional? tinyurl.com/2ffenawc

Yes, obviously the people who ended slavery wanted race discrimination in higher education. Silly of me for thinking that's unconstitutional

Five years ago today, the Supreme Court unanimously ruled that Philadelphia couldn't shut out faith-based foster care ministries—or heroic foster moms Sharonell Fulton and Toni Simms-Busch—simply because of their religious beliefs. Fulton remains a landmark victory for religious freedom and children in need of loving homes. @RonDeSantis The Constitution explicitly forbids states from doing exactly this: entering into compacts with each other.

Remember, the govt.'s position in Citizens United was that it could ban a documentary movie about a major presidential candidate in an election year simply because--like every other movie you have ever seen in a theater, on cable or broadcast, or on a streaming service--a corporation was involved in its production or distribution.
Institute for Free Speech@InstFreeSpeech

"The idea that citizens should be prohibited from criticizing a candidate during an election season because that speech could affect the outcome of the election is absurd. First Amendment exists in large part to facilitate democratic debate and allow voters to make informed decisions," via @insider_ct: ctinsider.com/waterbury/opin…
