Let’s be clear: the Union fails on multiple independent points of law, any one of which is fatal. No popular consent (UN Resolution 1541): Principle IX requires “the freely expressed wishes of the peoples… through informed and democratic processes.” That condition is absent in 1707, and under UN Resolution 1541 the requirement remains unfulfilled. 5. Failure of terms (treaty law): Core conditions of the Treaty were not implemented, which in treaty law renders the settlement void. 6. Material breach (treaty law): The settlement has been repeatedly violated over time, which in treaty law renders it void. Any one of these is fatal. Together, they are conclusive. No valid transfer of sovereignty. And without a valid transfer, this is not “union.” It is annexation - and annexation indicates colonisation.
