Here's my take on the subject -
If you came to the US on any temporary visa like B1/B2 or F1, then they will deny Adjustment of Status.
But if you are on any dual intent visa like H/L and employed - earning income, paying taxes, raising a US citizen - then all these factors qualify as National interest and hence your AOS will be accepted.
I think what they are trying to control - people come on B1/B2 and then apply for AOS - asylum cases/marriage etc.
This is how it will settle.

So much confusion with the recent announcement of USCIS Lots of FUD as well, so wanted to address them in the context of EB5 ( we have been in calls with multiple law partners all morning) 1/ Is EB5- EAD valid- Yes, RIA ( Reforms and integrity act) has spcific provisions for AOS - This announcement seems to be at cross with RIA provisions and most likely be litigated 2/ What is under attack- Some folks tried to do AOS under non dual intent visa (for eg B1, B2)- Those are not happening any more 3/ H1B is a DUAL intent visa- so in our view H1B-EAD should hold 4/ F1-EAD ( students who are doing EB5)- thats a grey area, waiting for clarity to emerge TLDR- Though controversial from headlines, this is as bad sounding as DJT taking away Birth Right Citizenship through the EO ( any one rememeber that)- Birth right citizenship is still legit and works There is billons of $ at stake both from EB5 and for non EB5- ( pending EAD for EB2 etc)- not so easy to do drastic changes like these with the stroke of a pen It adds to uncertainity, but this too shall pass like Birth Right citizenship fiasco

@carlwheless I didn't see anything that would affect an H-1B visa.
- However, if the H1B was planning to get a Green Card, they'll have to change their plans, and move home before they apply for that Green Card.

Smriti & Hiten both were really good in the episode today but overall I found the scene a bit too OTT for my taste ..
Unpopular opinion but I dint like how Tulsi gives those dozen slaps to her grown ass son Karan who is himself a father of elderly kids..Did Tulsi slap Mihir during Mandira & Noina kaand ? So why slap Karan even before knowing the entire truth??
Lets say Karan really had another family & cheated on Nandini , still those dozen slaps r not valid in my view bec Karan is not some young kid anymore ..Anyway ITV needs the impact in such scenes for trps , thats why Karan had to take some 12 slaps from Tulsi today for no fault of his as poor guy is only saving Virani family's ass by hiding Ansh's illegitimate son 😆..
I guess Niyati was actually the other woman in Ansh's life but mayb having some mental problem after Ansh's death & so assuming Karan is her husband & this Ansh & Niyati's son Rio aka Riyansh must b seeing Karan only as his dad since childhood , so he has no idea ..Karan might have taken their responsibility without informing Virani family bec he dint want Tulsi or Nandini to go through this Ansh trauma again 🤔..I guess tomorrow we will get complete back story when Karan will finally tells Tulsi about Ansh's son "Riansh"..
Tulsi had a complete crash out in rain today after seeing that same face which has changed her entire life after she shot him with her own hands ..She felt as if Ansh is standing in front of him again & those past memories of killing him started flashing in front of her eyes ..Smriti was outstanding in this scene as Tulsi literally got a panic attack seeing Ansh's lookalike😬..She kept going back & forth while Karan felt helpless here bec he cant even reveal Tulsi's identity to Rio & at the same time Rio was like a typical Gen Z kid questioning Tulsi by using some cool taunts for slapping his dad ..In the end Karan had to declare Tulsi as some mental patient in front of Rio to handle both hot blooded people 😭🤣..
While Tulsi had a crash out on road after getting the Ansh trauma , Karan too had his emotional outburst at his Malabar Hill home washroom 😭😅..Tulsi again called Karan on phone to know about this Ansh's lookalike & tomorrow we will get the answers ..Karan is a complete Maa-Paglu son or else the way he got those slaps today for no fault of his , no son would sit quiet & still continue to hide things for the Virani family honor..Gautam would never !! Karan is spl for a reason & Tulsi owe him an Apology once she is aware of the truth 😌..
Akashdeep as Rio aka Riansh looked elderly compare to Tulsi & Karan both bec Smriti & Hiten r actually younger than Akashdeep ..They got the same actor for the son's role to create that impact but agewise he is not at all fitting in the role..Mayb they need to give him a stubble look to make him look a little younger 🤔..
