What does this mean for RCR? RCR had the legal relationship with Hillin and Hillin had the legal relationship with the law firm. I would expect that if RCR pursued or identified a plan to pursue something against Hillin, Hillin would an in turn do the same to the law firm. I would not be surprised if this has been quietly resolved between December, and now as it relates to claims among the various involved parties. Any ethics issue would be separate and dealt with by North Carolina State Bar.

Back to OG #NASCOURT - confirmation on the last outstanding thing from the NASCAR antitrust trial. NASCAR’s primary outside law firm for that case used confidential documents related to RCR that were subject to non-disclosure agreements from one client in an effort to benefit another when questioning Richard Childress.

The Childress Matter: The court transcripts from the 23XI/FRM-NASCAR suit are out and we can now read what happened in sidebars in Judge Bell’s chambers. Regarding the Childress/Bobby Hillin/under NDA portion of the case… Hillin was a client of Latham & Watkins, which was the firm used by NASCAR. The attorneys knew Hillin had attempted to purchase part of RCR, as well as RCR financials, because Hillin was their client.

@ForRentCheap @SMMcMinimee Spire is laying foundation that process is far less formal and is separate. If they decide these things informally often, why sue now? CG taking info is separate from CG joining Spire. Also separate from alleged sponsor poaching.

@ForRentCheap @SMMcMinimee I disagree. JGR is asserting that a series of events happened that didn’t follow formal practices and/or were illegal. Spire talks to CG. CG talks to JGR to end job. CG takes private information. CG leaves JGR. CG gives to Spire. CG violates anti-compete.

So I just was thinking (I know, dangerous). Is it just me or does the whole premise that there was an unwritten “trade” agreement between JGR and Spire seem pretty inconsistent with the idea that CG has such a vastly different job at Spire? $100,000 or you give us your director of competition that we are going to say that we have hired for a ownership level position and are paying much more for a car chief. Did the extra tea and cappuccino push me over the edge or do that sound reasonable? #NASCOURT

Gabehart/Spire filed responses to JGR motion for prelim injunction. Main issues: -JGR: Gabehart role similar to JGR. Spire: More owner/big-picture focused than day-to-day competition. -JGR: It'd be hurt if info gets to Spire/Hendrick. Spire: It has no need for that info. (1/3)

@grc207 My understanding is she was using the definition within the employment contract of confidential information. So the things that were covered by these two provisions of the employment contract.

As I mentioned in my comments yesterday, I’m not surprised by this. This issue will be looked at in greater depth in the upcoming preliminary injunction hearing. While Spire’s position is that there is no overlap, I would expect that we will not see Gabehart at any NASCAR events while the TRO is in place.

Judge rules that Chris Gabehart can continue working for Spire Motorsports, but cannot perform any duties at Spire that he was doing as JGR's competition director -- basically, no overlap. Spire and Gabehart state that this decision has no impact as his role as Spire’s chief motorsports officer is different than that of a competitor director.
