The Clarity Act came into effect 2 years after the 1998 SCC Reference Case. The SCC case trumps the Clarity Act where the provisions conflict. Using the Clarity Act to create obstacles would be inconsistent with a province's rights under the SCC ruling and could be interpreted as bad faith. Carney misspoke today or does not understand the law.
