The most basic category error the left makes - repeatedly - on every police shooting is to characterize the shooting as an unjust "punishment" for the conduct of the person shot. They then argue that said person didn't "deserve" to be "executed," and so clearly the police officer is in the wrong. That's not what it's about. It's NEVER what's it's about. Punishment is administered through the judicial system. The right of a law enforcement officer to use deadly force in self-defense or defense of others is about the rights of the officer, his colleagues, and nearby civilians as human beings whose lives have value, too. They have a right to respond to the imminent threat of death or serious bodily harm with deadly force. And in exercising that right, they are not judged from the perspective of an omniscient superhuman, with perfect knowledge of everything happening in that moment; they are held to the standard of the reasonable person perceiving what they can from that viewpoint. In the words of William Munny, deserve's got nothing to do with it.

I carry a gun, legally. Let’s say I don’t like DUI enforcement. I think people should have the right to drive drunk. I see a DUI stop, I park my car, I get out with my gun in my hip holster, and aggressively confront the cops while they’re conducting sobriety tests.

At some point in time prior to the first shot being fired all of the following facts were true: 1. Pretti engaged in obstructive behavior. 2. Pretti committed a felony assault against a federal officer while armed. 3. Pretti resisted arrest while armed. 4. The fact that Pretti had a gun was revealed to all Officers there. So a person for whom there was PC he had committed a violent felony, was resisting arrest, and was armed with a firearm were among the totality of circumstances known to the Officer at the time he used deadly force. Use of deadly force policy does not require the Officers to wait until they are attacked.

Here is the thing about having a concealed weapons permit… The vast majority of the class time you are mandated to take in most states (including MN), is spent talking about *avoiding* confrontation. As an armed individual who is not a police officer, you have a duty to actively asses situations and make your highest priority to avoid them as best you can. The liability, emotional toll, and physical risk of getting into confrontations when armed is absolutely not in your favor. Setting out to interfere with police is absolutely not something on the mandate for a CCW holder. It is the exact *opposite* of everything taught in any one of the citizen lethal force legal trainings I have ever been in.

My speculation: I don't think the officer who drew and fired the first shot meant to shoot. When the other officer appears to disarm the deceased and run back, he shouts about the gun. That's when you see the officer standing behind the scuffle draw and fire. This very well could have been a situation where one officer misunderstands what's happening based on what's called out, rushes to draw his weapon, and accidentally fires. I personally don't see the deceased pull or reach for the gun (or his waistband, etc.) in the videos we have. And I don't think any of the other officers had any intention to fire until the first shot went off. But again, that's speculation. What that means legally, if that's what happened, I don't know. Someone smarter than me can lay it out.
