Lived experiences matter. During Kenya’s review by the Committee on Economic, Social and Cultural Rights (CESCR) in Geneva, the United Disabled Persons of Kenya (UDPK) and organizations of persons with disabilities stood witness as representatives of the Kenyan government presented their progress report to the CESCR Committee. While the government presented a narrative of universal inclusion, our delegation of women was on the ground to hear the gaps firsthand. Their presence highlighted why Alternative Reporting and the power of lived experience are our most vital tools for accountability. Reality Check: Policy vs. Lived Experience Our delegation listened as representatives of the Kenyan government made claims that do not match the day-to-day realities of persons with disabilities: Social Protection: The government asserted that cash transfers are non-discriminatory and benefit all persons with disabilities. But the reality is that only those with “severe” disabilities are currently targeted, leaving the vast majority of our community without a safety net. Communication Access: It was said that sign language interpreters are provided "everywhere". Yet, most schools, hospitals, and service providers lack interpreters; interpreters are mostly at Huduma Centres, select few hospitals or high-profile government functions. Political Representation: The government stated that persons with disabilities have representation in all 47 counties. With the situation on the ground, during the 2022 general elections, 21 out of 47 counties failed to nominate persons with disabilities to their legislative bodies. The Equalization Fund: Representatives noted that this fund ensures "no one is left behind". The truth is that the implementation of this fund has been crippled by litigation, low allocations against entitlement, and delays in disbursement. With minimal stakeholder engagement and low uptake, reports like the Kenya Demographic and Health Survey show that marginalized areas and the persons with disabilities living within them still lag far behind the rest of the country in accessing quality basic services. Why Lived Experience is Essential When members of the CESCR Committee asked follow-up questions on disability inclusion, the responses from the representatives of the Kenyan government were not satisfactory. Instead of offering concrete implementation plans, they often responded only with policy clauses. To progress, we must move past the era of 'policy recognition' to 'practical realization'. Join for Joy convened its regional and global team for a week of strategic planning and capacity building. As part of this process, UDPK facilitated a one-day training on disability inclusion and inclusive play. The training aimed to strengthen Join for Joy’s capacity to ensure that its sports, play, and expressive arts programme is inclusive and accessible to children with diverse disabilities across all countries of operation. We spent the day with the team unpacking what it really means to make sports, play, and expressive arts inclusive for children with disabilities. We played the games as they are usually done, then introduced different disability scenarios and adapted them in real time. Inclusive play is possible and practical when we are willing to make simple, low-cost adaptations that allow children with disabilities to take part fully in sports, play, and expressive arts. Disability is not the child, it is the barriers around them, and when facilitators are intentional about changing rules, space, equipment, and attitudes, participation naturally grows for everyone involved. Inclusion is measured by who is actively involved, contributing, and enjoying the experience and having fun. #InclusivePlay

#MigrantDay : Persons with disabilities who are displaced or forced to migrate due to conflict and other crises face heightened discrimination, danger, and limited access to essential services throughout their journey. These risks are driven by persistent physical, institutional, and attitudinal barriers they encounter while on the move. This #MigrantDay, our message is simple: Persons with disabilities , regardless of where they come from , have the right to safety, dignity, protection, and equal access to essential services. These rights come with shared responsibilities. As we mark #InternationalMinorityRightsDay, Government commitments such as paying SHA contributions for 200,000 vulnerable people (@MOH_Kenya) , establishing a KSh 500M National Minority Scholarship Programme (@EduMinKenya) ,and operationalizing the National Policy on Ethnic Minorities, Indigenous Peoples and Marginalised Communities (@AGOfficeKenya ) signal progress on inclusion. However, persons with disabilities within these communities face compounded barriers to accessing services compared to their peers without disabilities. According to UNFPA, women and girls with disabilities are 10 times more likely to experience gender based violence. This also translates to online gender based violence #GBV. On this International Human Rights Day, we joined our partners , @CMDKenya, @TISAKenya, @thekhrc, @TIKenya, among others , to honour the legacy of Rt. Hon. Raila Odinga. He unapologetically championed inclusive democracy, including facilitating the formation and adoption of the Disability League as a key party organ, and supporting persons with disabilities to participate fully in governance processes. His central role in the enactment of the 2010 Constitution was examplary and pivotal, as it enshrined the rights of persons with disabilities , highlighted in Article 54

Raila Amolo Odinga — Former Prime Minister of Kenya, Former Leader of the Official Opposition, and one of the foremost champions of multiparty democracy. From detention under one-party rule to a relentless campaign for inclusive governance, he stood firm in defence of civic liberties, constitutional reform, and the right of every Kenyan to choose their leaders. His life was a testament that the long walk to justice demands courage, perseverance, and an unshakeable belief in the voice of the people. ✊🏾📣 Raila’s sacrifice helped dismantle structures of political repression and paved the way for the restoration of pluralistic governance. He played a pivotal role in repealing restrictive laws, enabling the birth of multiparty politics — and ultimately championed the 2010 Constitution, embedding devolution, checks and balances, and inclusive governance as the foundation of our nation. 🇰🇪⚖️ In so doing, he transformed human rights from abstract ideals into lived realities for millions of Kenyans. ❤️🇰🇪 Today, as we host this luncheon in his honour, CMD-Kenya reaffirms its commitment to carrying forward the vision that Rt. Marking the Persons with Disabilities Day in refugees with disabilities context, we would like to highlight three key messages. First, we acknowledge the Government of Kenya, UNHCR, and other development partners for advancing the Shirika Plan, the flagship national initiative transitioning refugee camps into integrated settlements. This is a transformative moment for Kenya and for the refugee community. But to succeed, we must move beyond principles and take concrete action to embed disability inclusion in every component of the Shirika plan. This means ensuring all new infrastructure, schools, health facilities, housing, markets, roads, WASH and public spaces are designed and built to universal accessibility standards. It requires establishing streamlined systems for the identification, registration, and documentation of refugees with disabilities so they can access health care, rehabilitation, assistive devices, social health insurance fund (SHIF), social protection programmes, and county services without obstruction. It demands that education reforms incorporate inclusive learning materials, teacher training, assistive technologies, and accessible school environments. The Plan’s proposed refugee management information system must capture disability-disaggregated data and use it to guide budgeting, service delivery, and monitoring. The plan must formally include OPDs and refugee-led organizations in planning, budgeting, coordination and accountability mechanisms at national and county levels. These are not optional enhancements, they are essential steps to ensure the Shirika Plan delivers equitable, dignified, and sustainable outcomes for all refugees, including those with disabilities. Second, we must improve access to essential services for refugees with disabilities, both in camps and in urban settings like Nairobi. Many refugees with disabilities face barriers in obtaining documentation, recognition through National Council for persons with disabilities (NCPWDs), and access to health care, rehabilitation, education, psychosocial support, protection services, assistive devices, and livelihood opportunities. We call for strengthened systems that ensure timely registration, full recognition, and equal access for refugees with disabilities, so they can benefit fully from county and national services. Third, we would like to speak to the disability movement itself. As OPDs, we must ensure our own work reflects the diversity of the communities we serve. Refugees with disabilities are part of our national disability family. We therefore call upon OPDs to adopt a strong refugee-inclusive lens, integrating refugee issues into advocacy, partnering with refugee-led organizations, and ensuring that refugees with disabilities have a voice and a place in our programmes and leadership spaces.
