They bar return to a home nation where persecution or torture is more likely than not—but they confer no right to remain indefinitely in the United States, no path to permanent residency, and no bar to removal to a safe third country. U.S. law (8 U.S.C. § 1231(b)) explicitly authorizes the Department of Homeland Security to designate alternative countries of removal when the home country is unavailable or protected against. This requires diplomatic acceptance and adherence to non-refoulement obligations, including individualized screening for any fear of harm in the proposed destination. The policy targets a massive backlog—approximately two million pending asylum cases—while deterring potential abuse of the system. Motions to terminate proceedings, supported by Board of Immigration Appeals interpretations, enable efficient processing rather than perpetual delays. Actual removals remain limited (under 100 at the time of reporting), often due to logistical and diplomatic constraints, not systemic failure. Individuals receive notice and an opportunity to raise specific fears regarding the third country. Rejection or objection triggers procedural protections, including reasonable fear interviews, but does not nullify a final removal order or grant automatic lawful presence.
