It is not an ongoing, permanent psychological contract that forbids you from ever changing your mind later

You should get your facts straight, @RepMikeQuigley. The rule applies to NONIMMIGRANTS, not immigrants. An immigrant already has a green card. A nonimmigrant comes to the US on a temporary visa, and in most cases, by law, has to prove to a consular official that he intends to return home once the visa expires. No one who comes here on a temporary nonimmigrant visa has a right to stay permanently.

The Trump administration is now telling people who entered the country legally to “go home” and apply for green cards there. These are immigrants already legally working in the United States.   It was never about illegal immigration.

Um, “immigrants” don’t need to pursue anything because “immigrants” already have green cards—that’s what the word “immigrant” actually means. This rule applies to “nonimmigrants.” And since you obviously don’t know what that word means, it means they are here on TEMPORARY visas. Presumably, you can figure out what “temporary” means.

The OPT program shouldn’t exist. That’s the first problem. If a foreign student is so valuable to an employer, the employer can sponsor him for an immigrant visa. The problem is treating many nonimmigrant visas as de facto immigrant visas.

You study in the US, get an OPT, fall in love and get married, find a job, maybe even have a kid And then to be a permanent resident you need to quit your job, move away from your family and somehow survive 6 months in a country you left 4 years ago Ridiculous policy

@cojobrien You seem to be skipping over a few key phrases in the law: 1) “in his discretion,” which means it’s not a right, but a privilege; and 2) “immigrant visa is immediately available,” which very often there is not.

On USCIS’ new policy memo. No, the agency cannot end adjustment of status for nonimmigrant visa holders and no, it is not a “loophole.” Congress wrote adjustment of status into law 66 years ago and has spoken on it 20 times.

Can USCIS eliminate the ability of noncitizens to adjust status to permanent resident in the US, requiring them to return home and consular process at the American Embassy in their home country before returning to obtain green card status? Nope. Because _Congress_ said adjustment of status is available. In 1960. And since then has amended the adjustment of status law 20 times, setting new restrictions. This is not a “loophole.” Is USCIS establishing a new standard in its May 21st Policy Memo that any noncitizen must prove “extraordinary circumstances” in order to be eligible for adjustment of status to permanent resident here in the US? Well, nowhere in the Policy Memo does the agency use the term “extraordinary circumstances” - Crtl-F, it’s not there. USCIS has binding regulations that set out the requirements for adjustment of status, and if it wants to change those rules, it must comply with the Administrative Procedure Act and propose a new regulation. A Policy Memorandum cannot conflict with a law that has been on the books for 65 years. Does USCIS have discretion when it reviews applications to adjust status? Yes! Can it do through the back door what it cannot do through the front door? Nope.

@DHSgov @iaproject AC21 allows H1Bs to renew visa indefinitely if their I-140 is approved. Official Green Card process begins with PERM followed by I-140, so you expect them to start from their home country? Also what if someone already got I-140 approved and keep getting EADs indefinitely?

@Ricburton @iaproject What about the 75 countries where America has stopped green card applications? This means indefinite separation from spouses and children in some cases. We can do this better by changing the process going forward without harming those here now and legally doing it the right way.

Much of the problem with our immigration discourse is lines have been blurred between those who come here for temporary, specific purposes and. those who come to settle here permanently. Aspects of our law such as dual intent and birthright citizenship are part of the problem.

@cltncplan The rule has nothing to do with “legitimate extensions or renewed legal status.” It is about whether an alien here on a temporary visa can apply for a permanent visa without leaving the US to apply. No one here on a temporary visa has a right to stay permanently.

This could be a HUGE move by @USCISJoe! Aliens coming to the US on temporary “nonimmigrant” visas should have to leave the US to wait for green card applications to be processed. Congress should eliminate adjustment of status altogether by passing @RepEliCrane’s End H-1B Visa Abuse Act (HR 8443), but it’s good to see the Trump Admin going as far as it legally can to fix this problem.
