He cannot do this because they're legally married. In the United States if he were to do this, because the child was conceived while married, he is legally deemed the father. The woman holds the cards regarding everything else; she does NOT have to submit or approve testing of DNA, she does NOT have to agree to sign or approve of the husband's order to relinquish his rights, she does NOT have to seek the biological father and make/ask him to step up. The woman holds all the cards, the husband/legal father has very limited wiggle room on these matters int he states.

@ClownWorld Get a court forced DNA test as soon as possible to prove you are not the biological father and to prevent child support. Once you support the child as your own, it's harder to stop in many states. Especially after 2-4 years.

Additionally, across all states regardless of DNA testing, since the child was conceived during marriage the child is legally the husbands. The husband would have to divorce the wife, file a petition to have his rights removed from the child AND the biological father has to be found and willing to assume rights for the child. The mother has to sign off on all of this PRIOR to a judge making the decision AND the judge has the power to DENY the husband/legal father's motion he or she so chooses here in the United States.
