This suit does not challenge rules in place before November 2025 that expanded eligibility to families making up to 400% FPL, or more than 132k per year for a family of four (or double state median income). Facts are hard for Deb. Well, what ISN’T hard for Deb. Passing the bar stumped her three times and she can’t string two sentences together. #nmpol

A third-tier Republican candidate for governor — who lives in Arizona — is using a frivolous lawsuit in a despicable attempt to mislead New Mexico families and generate headlines for a campaign that is going nowhere. Universal child care is in effect and it is NOT being shut down, despite what this desperate candidate claims. The court did not order us to end the program, and this losing candidate is purposely sowing confusion and mistrust. The court said the state has an opportunity to respond before any action is taken, which is standard legal protocol. We will respond and we will prevail. The New Mexico Legislature already settled the underlying legal question when it passed Senate Bill 241, which provided both the funding and the authorization for this program. New Mexicans should know this: A man who wants to lead our state made a calculated decision to scare working families — parents who depend on child care to hold down jobs, pay their bills, and build a future here — because he is losing and he knows it. This is not the leadership New Mexicans want — it is desperation by a third-tier losing candidate who lives in Arizona.
