The General Assembly has now passed a bill that tells teachers exactly what they must say about January 6 and the 2020 election if the topic is discussed in a classroom. That should concern everyone who believes in the First Amendment. The government does not get to mandate historical conclusions or compel speech from teachers simply because a majority in Richmond prefers a particular narrative. Whether you agree or disagree with what happened on January 6 is not the point. The point is that in America the government does not get to dictate orthodoxy. If Governor Abigail Spanberger signs this bill into law, I am prepared to immediately represent interested parties and file suit seeking a declaration that the statute is unconstitutional. Laws that compel speech and prohibit certain viewpoints raise serious First Amendment problems, and those issues should be decided by the courts, not by politicians trying to legislate history. I also hope there are people out there right now raising money to engage lawyers like me to fight these battles. Constitutional litigation is expensive, and if citizens believe the government has crossed the line, the only way to push back is through the courts. If you are a teacher, parent, school board member, or otherwise directly affected and are interested in being part of a challenge once this becomes law, feel free to reach out. The minute it is signed, the question becomes whether anyone is willing to take it to court - and if you are - I hope to be the lawyer in that fight.
