Where to begin? Nowhere in Mensah's motion will you find meaningful engagement with the fact that Mensah signed a contract with Duke. Duke paid Mensah NIL money. In exchange, Mensah made commitments. Duke is now asking a court to hold Mensah to those commitments while the parties arbitrate their dispute. The "manifest injustice" Mensah complains of is the injustice of being bound by his own signature. The "irreparable harm" is the harm of not being able to take a better deal while still cashing checks from the old one. Contracts are not merely suggestions that expire when a more attractive offer arrives. This "emergency motion" makes me have zero sympathy for Mensah (I had some). He knew enrollment deadlines at the schools recruiting him just as well as he knew the transfer portal deadline— I assume schools like Miami and LSU publish their academic calendars, and I assume any coach recruiting this caliber of a quarterback communicates when he needs to enroll. Mensah signed Duke's NIL agreement. He took Duke's money. Now, having lost a TRO hearing because his lawyers failed to raise arguments they should have raised, he seeks the remarkable relief of having one Superior Court judge undo another's order— not because the law changed or because genuinely new facts emerged but because of, what, spring ball? Please, he can enroll in the summer.
