Thats actually idiotic, and would require an insider leak, but prosecution could show it’s not if it wasn’t, but they won’t, cuz it was. So their actions are consistent with the theory even if there’s no evidence yet (not that it matters to be true), which is more plausible than their story anyway.

The steakhouse where Tyler Robinson allegedly ate is slightly over 200 miles from Orem. He was allegedly spotted at the steakhouse around 8:45. Described as having eaten quickly and left. He allegedly sent the text message from Orem at around 11 o’clock. If they are off by even 15 minutes in their estimate as to when they spotted him at the restaurant, he could easily have made it to Orem in time driving 80 to 90 miles an hour. Did I make any mistakes here?

@Trillion0x You’re right. Defense can hold it for trial. When they have any evidence they must share it with prosecution. However, diligent and others have said this will positively prove innocence, so why hasn’t the defense contacted the waiter?

This is how you know Viva Frei is a con artist. The defense is allowed to hold its card for the trial, and commonly does exactly that. The defense can have incontrovertible proof TR was there at the time by another means. And they’re defending against the murder. Eating steak isn’t the crime.
