🚨 OBFUSCATION OF REALITY: The Truth Behind Armed Forces Disability Pension Exemptions 🚨 In a recent Lok Sabha reply (Q. 3787), the Govt explained its reasoning for restricting Income Tax exemptions for military Disability Pensions. 🏛️ THE GOVT STAND: The Government claims that because the previous Income Tax Law was repealed, the associated exemptions lapsed. Therefore, they argue that the current Finance Bill simply includes the exemption for Armed Forces Disability Pension "afresh" to maintain the old scope. 🛑 THE REALITY / COUNTER LOGIC: This is a clear obfuscation of the facts. The "new" reference to this exemption is both misconceived and mischievous. Here is why: ▪️ DILUTION: It actively dilutes the previous provisions and protections that had been in place for our soldiers since 1922. ▪️ DISCRIMINATION: It unfairly discriminates against disabled personnel who showed the grit to CONTINUE SERVING despite suffering a disability attributable to their service. ▪️ RETROSPECTIVE PUNISHMENT: This sweeping change has a retrospective effect, financially hitting veterans who are already drawing IT-exempted disability pensions. ▪️ FALSE "MISUSE" NARRATIVE: A disability pension is only accorded IF the underlying disability is strictly ATTRIBUTABLE to military service. This is determined by stringent standards and multi-level medical and administrative approvals. Using "misuse" as an excuse (often pushed through propaganda) is a completely invalid reason to dilute a soldier’s rightful benefits. I respectfully urge your immediate intervention regarding Para 108 (page 88) of the Finance Bill 2026, which proposes to withdraw the long-standing income tax exemption on disability pension for Armed Forces personnel who superannuated, completed their service tenure, or retired otherwise. No country taxes disability compensation of soldiers disabled in line of duty. This proposed amendment has caused deep pain and distress among disabled veterans across the country. Disability pension, including War Injury Pension, has remained tax-exempt since 1922. This exemption was never treated as a mere financial concession. It has always stood as a mark of national gratitude and a moral acknowledgment of the permanent sacrifice made by soldiers injured in the line of duty. A disability sustained during military service does not disappear upon retirement. The physical pain, restricted mobility, psychological trauma, and lifelong consequences remain the same whether a soldier is invalided out early or continues to serve until superannuation. In fact, those who continue serving despite disability display extraordinary resilience, commitment, and devotion to duty. Taxing them for completing their tenure sends a deeply unfair message that perseverance is a liability. The proposed amendment creates an artificial and discriminatory distinction between two equally disabled categories of veterans: those invalided out and those who completed service. Both suffered injuries attributable to or aggravated by service conditions. Both carry the burden of those injuries for life. There is no moral, functional, or equitable basis to exempt one and tax the other. Disabled veterans include officers, JCOs, and soldiers who have suffered limb loss, spinal injuries, gunshot wounds, blast trauma, frostbite, paralysis, hearing loss, sight loss, and other irreversible service-related conditions. Many have served in war and war-like situations, high-altitude postings, counter-insurgency operations, and counter-terror missions under severe physical and psychological stress. Their disabilities are not incidental; they are the direct result of duty performed in defence of the Nation. Further, service-related disability often affects career progression due to low medical categorization, reducing promotion prospects and long-term earning potential. After retirement, many disabled veterans are also less employable than their able-bodied counterparts. Imposing tax on the disability element of their pension would therefore not only be unjust in principle, but harsh in effect. If there are concerns regarding misuse in isolated cases, such issues should be addressed through targeted administrative scrutiny. Genuine disabled veterans should not be penalized because of procedural exceptions. The exemption was granted in recognition of permanent injury and sacrifice, not as a conditional privilege. This issue has caused serious anguish within the 32-lakh strong veteran and pensioner community. At a time when the Armed Forces continue to face manpower shortages, this measure risks weakening trust in the State’s commitment to those who serve and sacrifice. Please withdraw the Amendment to Schedule III under Para 108 (page 88) of the Finance Bill 2026, so that the tax exemption on disability pension continues without discrimination for all disabled Armed Forces personnel. This is not merely a taxation issue. Honourable Member of Parliament, When you address the august house on this issue on 16 Mar you will be conveying the collective anguish of countrymen cutting across party lines on the ill concieved proposal of taxing disability compensation of soldiers disabled in the line of duty and who still continued to serve. #KeepDisabilityPensionTaxFree has more than 2 Crore impressions on X and a petition on change.org has been endorsed by more than 50000. All eyes are on the house to reverse this proposal which dishonours sacrifices of soldiers without any tangible accrual to the exchequer.

A Sovereign Promise Broken: Et Tu Brutus? An Indian Fauji’s Commitment: “I swear in the name of God that I will bear true faith and allegiance to the Constitution of India as by the law established and that I will, as in duty bound, honesty and faithfully serve in the regular army of the Union of India and go wherever ordered by land, sea or air and that I will observe and obey all commands of the President of the Union of India, and the commands of any officer set over me even to the PERIL OF MY LIFE.” This is the oath every soldier takes. No other service, except the defence services pledge their lives and bodies to the nation. Soldiers forfeit their fundamental rights with utmost faith in the Conscience Keeping Polity and Media that they and their families would be taken care of by the nation in case of their death or disability. No one else in the country pledges this! It is a betrayal when such faith is broken in retrospect. It alarms when a government goes back on sovereign promises which were kept sacrosanct by governments of varied political affiliations since independence. @BJP4India, @PMOIndia, @nsitharaman, @rajnathsingh now want to revert the sovereign promise that income tax on pension of soldiers who are disabled in line of duty will be exempt from income tax. No country in the world taxes compensation given in lieu of bodily harm suffered in line of duty. Old, disabled, unemployable veterans now have to take a monthly cut of 25% with NO means to alternatively earn than amount. Voice of people in a democracy is unstoppable.
