SCOTUS may rule that birthright citizenship is constitutional, using precedent and a loose interpretation of an earlier ruling, so we may need to approach the issue of one million Chinese communists voting in our elections in the future differently. As it holds, they can’t even be denaturalized. There would definitively and permanently be no solution and creating citizens of those who dilute our values is republic ending. What we can do now, is aggressively and publicly enforce FARA, the Espionage Act, and related statutes against anyone (citizen or not) acting under CCP direction. Prosecute espionage, influence ops, and undisclosed CCP ties. That’s really it though. If it’s ruled constitutional for anyone infiltrate and dismantle our republic, all we can do is try to disincentivize it. How utterly demoralizing.

@bonchieredstate @GoatMcLean_ It literally says born or naturalized in the United States , and subject to the jurisdiction. Thats not vague. You just don’t like the obvious answer. Its not everyone that sets foot because they were neither born in the US nor naturalized. But babies born here were.

To me, the birthright citizenship case is one that's so painfully obvious when you apply both a historical lens and common sense. Anchor babies were not the intent. But also, the language is just vague enough that without a new amendment, we'll never get it overturned.

You guys understand we’re going to lose the birthright citizenship case, right? Before you completely freak out, the traditional understanding of the 14th Amendment, which we are seeking to change, is not an insane reading of it. Nor are our arguments insane like the left has been same. That’s baloney to just shut us up. Neither side is frivolous. It’s a tough call legally and objectively speaking. But when we lose it, and I think we will, don’t freak out that this is some sort of conspiracy. It’s a hard legal decision. Sadly, we have three judges who aren’t even going to try to examine the question and will always vote for what leftists want. But the rest of the court has to make a tough legal call. I think our reading is the correct one. For various reasons, I think they’re going to rule against us. Don’t freak out when they do. It’s not an utterly irrational ruling like so many of the district court opinions we’ve seen.

@KeithGross @JustinWStapley Thats just not true, jurisdiction has nothing to do with allegiance and everything to do with if the US laws apply to you or not. Thats why the Amendment excludes the children of foreign diplomats who have diplomatic immunity, aka they aren't under our jurisdiction

If illegal immigrants are not "subject to the jurisdiction of the United States" under what authority can the federal government deport them? This is the problem with living constitutionalism and consequentialism, it seeks to craft constitutional law that is a tangle of knots, twists, and turns to wrest the foundational document of our republic toward whatever fancy the zeitgeist arrives at. The originalist path not only makes more sense but actually accomplishes the whole point of having a written constitution...the consistent application of the rule of law according to text, history, and tradition.

Domiciled is legally defined as "having your permanent legal home" in a particular place. You can only have 1 domicile.

In the Wong Kim Ark case, it was further defined as "owing direct and immediate allegiance to the United States."

No, they're not. They are citizens of another country. Their primary allegiance is to another country. That's why the US Oath of Allegiance for foreigners being naturalized says: "I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen;"
