Fact: There is legitimate disagreement over whether a sitting president is immune from criminal prosecution.
Fact: No president in 247 years has been criminally indicted.
Fact: Impeachment is how we hold presidents accountable for misdeeds in office.
Fact: Trump was impeached by the House and then acquitted by the Senate on charges he incited the January 6th riot.
Therefore: SCOTUS must decide whether that acquittal by the Senate is the legal equivalent of an acquittal in a criminal court.
If not equivalent, then prosecute away.
But if equivalent, then to prosecute Trump criminally for the same charges for which he has previously been acquitted legislatively constitutes Double Jeopardy.
Regardless of your opinion on the merits of this claim, this is an original question, never before decided by the high court.
That is why the justices have agreed to decide this consequential issue.

Breaking down the Yankees’ playoff odds:
FanGraphs today has it at 0.3%. I think this is accurate.
They trail Boston by 3 games, and Toronto by 7 games.
They play Boston 4 times, and Toronto 6 times. They would likely need to win all 10 of those games.
That would leave Texas, Houston, or Seattle to catch (whichever is the weakest of the 3).
Houston plays Texas 3 times.
Houston plays Seattle 3 times.
Texas plays Seattle 7 times.
If the Yankees were on a torrid stretch, their best hope would be for Houston to take over the lead in the AL West, so that they could gain on Texas or Seattle during their head to heads.
Overall, I think the Yankees will need to win a minimum of 20 of their remaining 25 games for this to be a conversation. That *still* might not be enough, but the head to heads would dictate that they would at least threaten in this scenario.
I think we all know it won’t happen, but for those who like to keep track, here it is.

@mxxsullivan @davetheman80 @charliekirk11 If Thomas had corrected them prior to getting busted, then that becomes a different issue. It still remains a big issue that there are not ethics requirements for the Supreme Court. It is wrong for all of them to be accepting tens of thousands in gifts.

So Liberal SCOTUS Justice Sotomayor took over $3 million from Penguin Random House and didn’t recuse herself from multiple copyright cases involving the publisher—with rulings that sided in favor for Random House and saved them mountains of $$—even though Justice Breyer did recuse himself while getting paid far less by the same publisher.
Given the breathless coverage over contrived controversies involving Justices Thomas and Gorsuch, it’s great to see solid conservative reporting punching back and giving the left a taste of its own medicine.
