If you do not realize that strange things are going on in the real estate market, listen up. Client inherited a house with some forested land in rural Michigan. It is not on a lake. Property inherited 12 years ago. Client wisely got an appraisal as of date of death 12 years ago. They just sold it, NET of real estate fees, for five times the value of the property 12 years ago. Junior acquisitions people, here’s the perfect cold-call script. Me: hello? You: hello. I’m [ ] calling from [ ] company. I’m interested in purchasing [ ] property. If you’re considering a disposition, I’d be interested in making an offer. That’s it. Don’t ask how I am, or how my day’s going, or any other bullshit like that. It’s not that “I’m too good” to answer those questions, it’s simply that we’re complete strangers and feigning interest in my day comes off as insincere. A quick intro and a direct ask about a property you’ve researched shows that a) you’re prepared and b) you value your time and respect mine. Remember, you’re calling me at my job, about my job. I’m not going to be irritated by a professional inquiry. Hell, that level of directness (rare to find these days) may even catch me off guard enough to send you some financials and see where it goes. Simple. No fluff. Don’t over think it.

Dealing with an interesting property law issue: Three individuals decide to build a 3-unit commercial building together. They purchase the land, create an LLC, quitclaim the land to their LLC, and then build the building. Years later, with the property still in the name of the LLC, they sign (as individuals, not on behalf of the LLC) and record condo documents that say each of the units is owned separately by one of the three individuals, and the common areas are owned by all three as tenants in common. No mention of the LLC in the condo docs. The taxes show up in the name of the LLC, and the insurance is in the name of the LLC. Which controls? The quitclaim deed transferring the property to the LLC or the condo docs that say that each individual owns one unit and the common areas are owned by all three as tenants in common?
