@LFCVijay @Ayyappan_1504 Situational discretion isn't just choosing between claimants. For instance, Rameshwar Prasad 2006 SC said Governor can't BLOCK a party. But TVK came 6 MLAs short themselves. Governor isn't blocking he's assessing viability under Article 163. That's due diligence, not obstruction

When #TVK Chief Vijay asked to form government, reports says Governor told him he must first show support from enough MLAs for a majority before the swearing-in. It would be against the Constitution. When no party has a clear majority, the single largest party should be invited to form the government and given time to prove its majority. Supreme Court clearly said that majority should be proven in the Legislative Assembly not at Governor’s residence Same incident happened bon 1996 Parliament Election & 2018 Karnataka Election

@Telugu360 For those talking about floor test, Support letters ≠ Floor test. Governor asking for letters BEFORE invite is Article 163 discretion. Floor test is proving majority IN Assembly AFTER swearing-in (Bommai 1994). TVK hasn't even been invited yet. Bommai doesn't apply here at all.

In a way, the Tamil Nadu Governor’s decision is constitutionally justified. A Governor is expected to invite a single largest party or alliance to form the government ONLY after verifying that it has the support of 50%+ MLAs through signed letters of backing.
