Again, the law is clear that hospitals and other protected buildings lose their protected status if used by enemy combatants (Fourth Geneva Convention Article 19), as has been documented in Hamas’ case. AP1 Article 41(2) is clear that an injured enemy’s protected status is provisionals, “provided that in any of these cases he abstains from any hostile act.” According to ICRC commentary, hostilities include command and control, including: “the planning, direction, or coordination of military operations.”
