IS APARTMENT SALE DEED REGISTRATION NOT TAKING PLACE IN I? ରେଜିଷ୍ଟ୍ରେସନ ବନ୍ଦ ନାହିଁ I କୌଣସି ନ୍ୟାୟାଳୟ ର ଆଦେଶ ବି ନାହିଁ ବନ୍ଦ କରିବାକୁ I ଯେଉଁମାନଙ୍କ ପାଖରେ ଠିକ ତଥ୍ୟ ଏବଂ କାଗଜ ପତ୍ର ଅଛି, ସେମାନେ ରେଜିଷ୍ଟ୍ରେସନ କରି ପାରୁଛନ୍ତି I ଆପାର୍ଟମେଣ୍ଟ ଆଇନ ଅନୁଯାୟୀ ନିଯୁକ୍ତ କମ୍ପିଟେଣ୍ଟ ଅଥରିଟିଙ୍କର ଅନୁମୋଦନ ଆବଶ୍ୟକ I ତାଙ୍କ ବିନା ଅନୁମୋଦନରେ ସେଲ ଡିଡ଼ ରେଜିଷ୍ଟ୍ରେସନ ୦୭-୧୧-୨୦୧୫ ଠାରୁ ବନ୍ଦ ଅଛି I କିନ୍ତୁ ତାହା ନ ମାନି ଆଇନ ବିପରୀତ ରେଜିଷ୍ଟ୍ରେସନ ହେଉଥିଲା I ବର୍ତମାନ ଆଉ ଏହିଭଳି ବେଆଇନ ରେଜିଷ୍ଟ୍ରେସନ ହେଉ ନାହିଁ I 1⃣ଜମି ଉପରେ ପ୍ରତିଶତ ଭାଗ: ଆପାର୍ଟମେଣ୍ଟ ଏମିତି ଏକ ସମ୍ପତି ଯାହାର ଦୁଇ ଭାଗ ଅଛି (୧) ଆପାର୍ଟମେଣ୍ଟ ଏବଂ (୨) ଜମି ଉପରେ ପ୍ରତିଶତ ଭାଗ କୌଣସି ଆପାର୍ଟମେଣ୍ଟ ସହିତ କେତେ ଜମି ଭାଗ ଅଛି ତାହା ଅନୁମୋଦନ ହେଵା ଆବଶ୍ୟକ I ଏହି ଅନୁମୋଦନ କୁ "ଘୋଷଣା ପତ୍ର ବା Declaration" କୁହାଯାଏ I ବିନା ଘୋଷଣା ପତ୍ର ରେ କୌଣସି ରେଜିଷ୍ଟ୍ରେସନ ହେଵା ଆଇନ ବିରୁଦ୍ଧ I କିନ୍ତୁ ରେଜିଷ୍ଟ୍ରେସନ ଅଧିକାରୀ ବର୍ଷ ବର୍ଷ ଧରି ଏହି ଆଇନ କୁ ମାନି ନାହାନ୍ତି I ଯଦ୍ୱାରା ଜମି ର ସଠିକ ଭାଗ ଅନୁମୋଦିତ ନୁହେଁ I ଏହି ଅବ୍ୟବସ୍ଥା ର ଲାଭ ଉଠେଇ, ଅନେକ ନିର୍ମାଣକାରୀ ସଂସ୍ଥା ଚାଲାକି କରି ପ୍ରକଳ୍ପ ର ସମ୍ପୂର୍ଣ ଜମି କୁ ଭାଗ ନକରି ରେଜିଷ୍ଟ୍ରେସନ କରିଛନ୍ତି I ଅର୍ଥାତ ଆଜି ବି ଅନେକ ପ୍ରକଳ୍ପ ରେ ଅନେକ ଜମି ର ମାଲିକାନା ନିର୍ମାଣକାରୀ ସଂସ୍ଥା ପାଖରେ ଅଛି I କଣ ଠିକ ପ୍ରତିଶତ ଭାଗ ପାଇବା କ୍ରେତାଙ୍କର ଅଧିକାର ନୁହେଁ ? 2⃣OCCUPANCY CERTIFICATE (ଓସି) : କିଣା ବିକା ପୂର୍ବରୁ, ଆପାର୍ଟମେଣ୍ଟ ର ଜମି ର ମାଲିକାନା ଠିକ ଅଛି କି ନାହିଁ, ଆପାର୍ଟମେଣ୍ଟ ଟି ଅନୁମୋଦନ ଅନୁଯାୟୀ ତିଆରି ଏବଂ ଆପାର୍ଟମେଣ୍ଟ ଟି ବାସପଯୋଗୀ ହୋଇଥିବାର ସାର୍ଟିଫିକେଟ ହେଉଛି "ଓସି" I ଭୁବନେଶ୍ୱର ପାଇଁ "ଓସି" ର ନିୟମ ଆସିଛି ୧୯୯୩ ମସିହାରୁ I ସରକାରଙ୍କ ଅପାରଗତା ଏବଂ ବିଲଡର ମାନଙ୍କ ଅଧିକ ଲାଭ ମନୋବୃତି ଯୋଗୁ ଅଧିକାଂଶ ପ୍ରକଳ୍ପ ରେ "ଓସି" ନାହିଁ I ବିନା "ଓସି" ରେ କୌଣସି ଘରେ ରହିବା ଆଇନ ବିରୁଦ୍ଧ I କିନ୍ତୁ, ଲୋକ ହଇରାଣ ହେବେ ଏବଂ ସରକାରଙ୍କ ଓସି ଦେବାରେ ବିଳମ୍ବ କରୁଛନ୍ତି କହି ଅନେକାଂଶ ପ୍ରକଳ୍ପରେ ବିଲଡର ମାନେ ଓସି ନଥାଇ ମଧ୍ୟ ଘର ହସ୍ତାନ୍ତର କରିଛନ୍ତି I ପ୍ରକଳ୍ପ ରେ ଥିବା ବିଭିନ୍ନ ତ୍ରୁଟି କୁ ଲୁଚିବା ପାଇଁ ଅନେକ ବିଲଡର ଏହିପରି କରିଥିବାର ଦୃଷ୍ଟାନ୍ତ ଅଛି I ବର୍ତମାନ ବିଭିନ୍ନ ନ୍ୟାୟାଳୟ ଏମିତି ସବୁ ଅଟ୍ଟାଳିକା ଯାହାର ଓସି ନାହିଁ, ତାହା ବାସପଯୋଗୀ ନୁହେଁ ବୋଲି ନିଁର୍ଧେଶ ଦେଇଛନ୍ତି I ଏପରିକି, ଏଇ ସବୁ ଅଟ୍ଟାଳିକା କୁ ଭାଙ୍ଗି ଦେବାର ନଜିର ଅଛି I ଯଦି ଅତୀତରେ ଓସି ବ୍ୟତୀତ ରେଜିଷ୍ଟ୍ରେସନ ହେଇଚି ଏବଂ ସରକାର ପ୍ରକୃତରେ ଜନସାଧାରଣଙ୍କ ହିତ କରିବାକୁ ତତ୍ପର ତେବେ ଓସି ନଥିବା ପୁରୁଣା ପ୍ରକଳ୍ପ କୁ କେମିତି ଓସି ପ୍ରଦାନ କରାଯାଇପାରିବ ସେ ବିଷୟରେ କୌଣସି ପଦକ୍ଷେପ କାହିଁକି ନେଉ ନାହାନ୍ତି? ଯେଉଁ ୯୬% କ୍ରେତା ତାଙ୍କ ଆପାର୍ଟମେଣ୍ଟ କୁ ବିକ୍ରି ନକରି ସେହି ପ୍ରକଳ୍ପ ରେ ଅଚିନ୍ତାରେ ରହିବାକୁ ଚାହୁଁଛନ୍ତି ସେମାନଙ୍କ ବିଷୟରେ ଚିନ୍ତା କରିବା କଣ ସରକାରଙ୍କ ଦାୟିତ୍ୱ ନୁହେଁ ? @SecyChief @ushapadhee1996 @OdishaRera @dr_kcmahapatra @sureshkpujari PLEASE🙏 ensure, ସମ୍ପୂର୍ଣ ଜମି ଉପରେ ମାଲିକାନାସତ୍ଵ ଏବଂ ପ୍ରକଳ୍ପ ର ବାସପଯୋଗୀ ପ୍ରମାଣପତ୍ର I

OCCUPANCY CERTIFICATE #Odisha especially the Home Buyers must learn from this Bombay High Court's order. Bombay High Court has asked all residents of a building, staying without OC to vacate within two weeks. The importance of OC must be understood by the Home Buyers, the Dept. @HUDDeptOdisha the Secretary @ushapadhee1996 To gain cheap mileage with limited knowledge on the subject matter the ministers @sureshkpujari and @dr_kcmahapatra must ask their builders friend to follow the law. If the ministers and the @CMO_Odisha @SecyChief really want to help the Home Buyers, especially the owners of old apartments, they should take steps to regularise buildings without OC. Stop taking help of false narrative that, "registration have stopped"..... why both ministers are not uttering a single word when it comes to the legal position of a building without plan approvals OR without Occupancy Certificate OR on illegal land ❓ timesofindia.indiatimes.com/city/mumbai/no…

Odisha Apartment (Ownership and Management) Act, 2023: Implementation Gaps and Homebuyer ChallengesThe Odisha Apartment (Ownership and Management) Act, 2023, has shown significant progress, with impressive execution rates by the Bhubaneswar Development Authority (BDA). However, bureaucratic apathy and delays are denying homebuyers their legitimate rights. Below is an analysis of achievements, gaps, and recommendations to strengthen the Act’s implementation. Achievements by BDA (2024-2025) ✅ Association Registration: Applications: 519 Registrations Completed: 419 (Certificates Issued) Execution Rate: 80% ✅Declaration Applications: (Builder submits project details and share of land/common areas): Applications: 70 Approvals: 60 Execution Rate: 86% ✅Form G Approvals: (Endorsement for transfer of land/common areas to registered associations): Applications: 60 Approved: 50 Execution Rate: 83% CRITICAL GAPS IN IMPLEMENTATION ⬇️ ✅Gap Between Registered Associations and Declaration Submissions: Issue: Despite 419 registered associations, only 70 declarations have been submitted by builders. Possible Reasons: -Lack of Occupancy Certificates (OCs). -Builders’ reluctance to lose control over project land. -Alleged assurances from authorities for amendments introducing “federation” models or relaxed land transfer rules. Impact: Homebuyers are deprived of their rightful ownership of common areas and land. ✅Gap Between Form G Approvals and Land Transfers: Issue: Of the 50 approved Form G applications, builders have not completed registration to ensure land transfers to associations, affecting thousands of apartments. Possible Reasons: -Lack of clarity on stamp duty for common areas/land. -Builders’ refusal to pay stamp duty. Impact: Homebuyers face delays in securing legal ownership, despite compliance by the Competent Authority. RESPONSIBILITY & ACCOUNTABILITY⬇️ Builders: Primarily responsible for obtaining OCs and completing land transfers. Plan approving Authority: Lacks robust audits and enforcement, contributing to delays. Homebuyers: Bear the brunt of these failures, despite no fault of their own. ADDITIONAL DEVELOPMENTS⬇️ Complaints and Appeals: -The Competent Authority (BDA Secretary) has addressed multiple complaints. -The Appellate Authority has issued orders in five appeals. -Some cases have escalated to the High Court. -Sale Deeds: A few sale deeds have been registered post-endorsement, a positive step. RECOMMENDATIONS Clarify Stamp Duty: The government must issue clear guidelines on stamp duty for common areas/land to expedite Form G registrations. Strengthen Enforcement: Conduct regular audits by BDA to ensure builders comply with OC and declaration requirements. Impose penalties for non-compliance to deter delays. Prevent Amendments contrary to law: Ensure no amendments (e.g., “federation” models) dilute homebuyers’ rights without transparent consultation. Streamline Processes: Create a dedicated task force to monitor and resolve bottlenecks in declaration submissions and land transfers. Protect Legal Registrations: Enforce strict compliance with legally valid sale deed registrations to safeguard homebuyers’ interests. Call to Action Hon’ble Ministers @sureshkpujari @dr_kcmahapatra @SecyChief @_anugarg @ushapadhee1996 we urge you to address these gaps urgently. The BDA’s progress is commendable, but homebuyers continue to suffer due to systemic delays. @CMO_Odisha, please ensure only legally valid sale deed registrations are permitted to protect Odisha’s homebuyers.Let’s make the Odisha Apartment Act a true success for all stakeholders. 🙏l

Thank you @TOIBhubaneswar for highlighting the Odisha Apartment (Ownership & Management) Act, 2023, a victory for homebuyers after decades of struggle (1982-2023). Key achievements: (1) Legal identity for Associations, (2) Land ownership rights. But challenges remain for the #OdishaHomeBuyers: The 2023 Act followed a homebuyers’ movement since 2018, with 4 Odisha HC & 2 SC cases forcing the change. Yet, some officials & builders are trying to block older projects from rightful land ownership transfer. The most damaging statement came from the @rdmodisha minister that the RE(R&D) Act was never meant for Odisha and his Govt. will change the law. Further, @HUDDeptOdisha published a notification, coining a new concept of "Prior to RERA". FALSE NARRATIVE: Claims of "registrations stopped" by a few are misleading. No court order halts apartment registrations! As a matter of fact, the Sub-registrar is duty bound to accept all sale deeds. Then allow registration OR pass a written order if rejected. STAMP DUTY: Why are new apartment registrations which constitute 96% of total apartment sales stalled? Exploiting delays in stamp duty amendments for common areas registrations, Is this to undermine the Act❓ @dr_kcmahapatra @sureshkpujari Regarding resale, please clarify! #Transparency Q1: Why no steps to regularize old buildings❓ Q2: Why label buildings "unauthorised" when the government allowed illegal constructions & registrations❓ Q3: Why can’t Buyers’ Associations apply for Occupancy Certificates and claim land ownership❓ While the ministers are busy protecting the sellers (including the builders), what about the interest of the buyers❓ Without legally valid documents mere registration does not confer Ownership: Supreme Court in K. Gopi vs Sub-registrar (Civil Appeal No. 3954 of 2025) @_anugarg @ushapadhee1996 #DeoRanjanKumarSingh @IgrOdisha please ensure regularisation, valid documentations, transfer of entire land to owners associations in the old projects so that the existing buyers as well as re-sale buyers do not face any legal hurdle in future. Your apathetic attitude towards the Apartment Buyers is well known. Please do not forget your "public trust responsibilities". While this development gives HOPE to the Home Buyers, it raises a few questions as well, 1) Why did it take 7 years? 2) Why the execution of @OdishaRera orders is far below the national average? 3) Why the Certificate Officers under the OPDR Act are not willing to carry out the Recoveries? 4) Why the @CMO_Odisha @HUDDeptOdisha is unwilling to provide the infrastructures and manpower to ORERA so that it can execute its own order efficiently? and 5) Why the direction of the Supreme court to complete all certificate cases within 6 months is not honored in Odisha? @LawOdisha @PrithivirajBJP @dr_kcmahapatra @AcharyaPitamba1 @ushapadhee1996

सत्यमेव जयते The Super 18 ODISHA'S REAL ESTATE REVOLUTION and the story behind Rs.13+ crores compensation: In 2010, the Odisha State Housing Board, a credible state-owned entity, teamed up with M/s Vipul Limited, a Delhi-based, listed company famed for its Gurgaon projects to launch "Vipul Greens," the state’s first Public-Private-Partnership (PPP) real estate project. Situated opposite the upcoming AIIMS, on a 4.65 acres land the project boasted premium 3 and 4 BHK apartments and a helipad atop what was poised to be Odisha’s tallest building. Priced at nearly 1 crore, a staggering figure for the state. The project drew doctors, NRIs, retired bureaucrats and defense personnel, all eager for a 2015 move-in. Construction crawled until 2015, when Vipul Limited’s gaze shifted to "Arohan" in Gurgaon. “Vipul Greens” stagnated. By then only one out of three residential towers had some visible work completed, but the Commercial complexes were not even started. The local officials of the company were non-responsive. The head office at Delhi were almost out of bound for the buyers. In 2016, the Real Estate (Regulation and Development) Act (RERA) emerged, igniting hope. Eighteen buyers, strangers united by betrayal stepped forward. Dr. Prasant Raghav Mohapatra, a doctor among the buyers, sparked the movement with a WhatsApp group. Bimalendu Pradhan, an IT professional and a buyer in the project, became its heartbeat. Waiting beneath a tree at the project site, chatting with guards, and braving threats from the builder’s henchmen, Bimalendu tirelessly gathered contacts. In no time, The group swelled past 50. When talks with Vipul’s General Manager, Rashmi Ranjan Das, collapsed, the Super 18 made it clear to the builder about their intention to go legal. In a stunning twist, Vipul offered possession without an Occupancy Certificate (OC), a legal necessity the industry ignored. The buyers refused, demanding compliance. they collectively turned to ORERA, filing Complaint Case no. 55 of 2018 on April 12, 2018. Thus began the saga of the Super 18. ORERA ruled swiftly, but the builder’s resistance spawned 17 more cases. Pramod Agarwal, a chartered accountant, represented the group of 17, while Bimalendu, self-taught in RERA law, fought his own. Their stand forced the builder to retract the offer, and a year later, the project secured its OC. This defiance thrust "Occupancy Certificate" into Odisha’s real estate lexicon, awakening buyers and authorities alike. A Wider Battle: Victory was fleeting. With no functioning RERA Tribunal, Vipul sought a stay from the Odisha High Court. Bimalendu countered with a Public Interest Litigation (PIL), W.P.(C) No. 8158 of 2019. On July 1, 2020, Justice B.R. Sarangi lambasted the state’s apathy, ordering the Tribunal’s activation within 15 days or face contempt. The Tribunal roared to life, a triumph for all litigants in the state. Bimalendu’s crusade grew. Observing the dormant Odisha Apartment Ownership Act of 1982, he filed Writ Petition W.P.(C) No. 13032 of 2019 and later W.P.(C) No. 18799 of 2021, compelling the state to enact a new law aligned with RERA. Today, hundreds of "Associations of Allottees" thrive. Another Writ Petition W.P.(C) No.8467 of 2019 by Bimalendu, birthed ORERA Rule 26(2), empowering ORERA to execute orders under Section 40(2). Throughout, the other 17 remained firmly united in their support for Bimalendu. Another name which came to prominence was that of Advocate Mohit Agarwal. Mr. Agarwal has emerged as a pivotal figure in safeguarding the rights of home buyers in Odisha through his relentless legal advocacy. Known for his expertise in real estate law, Agarwal has taken on significant cases that address the grievances of buyers against builders and regulatory authorities. The Cost of Justice: Yet, execution lagged. ORERA’s recovery orders, sent to collectors under the Odisha Public Demands Recovery (OPDR) Act, gathered dust. Bimalendu’s PIL, W.P.(C) No. 23341 of 2022 to enforce execution of ORERA orders was dismissed by the High Court as "private interest," fining him ₹2,000. Undeterred, he appealed to the Supreme Court. Triumph at the Apex: The Supreme Court stayed the fine, seized Vipul’s assets & Bank Accounts. At the beginning Vipul paid 75 lakhs to Bimalendu. Later on March 28, 2025 Vipul did not have any other option but to file an affidavit promising over ₹13 crores plus further interest to the remaining buyers. Legacy of the Super 18: From a WhatsApp group to the Supreme Court, the Super 18 led by Bimalendu’s tenacity rewrote Odisha’s real estate story.
