Rights are subject to regulation. Certainly the authority of the federal government to regulate this one can be called into question, as it lacks a police power. But calling something a right doesn't make it a trump card.

There are no tech or date limits to Rights. Rights aren't treated like that. If the American people want machineguns banned, the ONLY CONSTITUTIONALLY ALLOWED ANSWER is to ratify an amendment banning private ownership of machineguns. Any doctrine saying otherwise is crazy.

There’s something awry in a legal culture that treats this kind of abuse of the system as having “no impact on the legal analysis.” That’s no more reasonable or lawyerly than ignoring the humanitarian interests on the other side.

Yeah, there was a time when his populist schtick really was just a schtick, and his governance was very credible and traditionally conservative, but at some point the schtick took over and became more of who he actually was, and his political future has cratered accordingly. He will not be in the 2028 conversation, even if his fortunes are resuscitated somewhat by a Trump admin appointment.

DeSantis has become an anti vax, anti AI populist. I used to like him a lot but to many unforced errors. I’m sure he is a competent governor but he has used his power to reshape the whole state of Florida. That is not conservative. It’s right wing activism. I’m not going to say anything more on this subject as I don’t see him being a national candidate again but I’ll probably mute and unfollow more of his ardent followers

@GeraldoRivera Leaving NATO is indeed our right. But deciding to leave NATO is indeed *our* right, not his. As a faithful servant of the nation, he has a duty to sincerely uphold NATO as long as remaining is what we choose.

It's not that he doesn't understand it, it's that he couldn't care less, he knows much of his base doesn't care either - even when he casually utters ever more brazen lies like this one - and he's gambling that those who do care lack either the will or the power to do anything about it. Whereas Democratic lawfare and schemes to pack the court entail a dictatorship of the party, GOP acquiescence to Trump's lawfare and contempt for constitutional constraints entail the dictatorship of one man. Both parties are now grave threats to the constitution and the rule of law, each side using the other side's sins to rationalize its own. Each side cynically pretends to be motivated by patriotism, but in reality each side puts partisan advantage above the common good, and hatred of enemies above love of country.

Trump doesn’t understand even the most basic aspects of constitutional law. Here, he says that no other country follows our Constitution (right, it’s the U.S. Constitution) and also that Congress’s voting on war (which is its role under the Constitution) is unconstitutional.

My guess is SCOTUS is going to be incredibly resistant to stuff like this, and I get it, but at the same time, I am mad at SCOTUS for eviscerating Bivens. If SCOTUS doesn't want states to do this, its majority should admit it was wrong in its Grand Theories and restore Bivens.

@ChrisCat1964 @JonathanTurley Take the possibility of impersonation. If the news says police are asking help identifying a suspect, it's always easier if you can see his face. It would be helpful if people see someone masked to be able to immediately rule out him being a cop.

Can anyone who has read Judge Oldham’s QI article defend his section on English common law. He tries to say that QI has a common law pedigree because *checks notes* there were a couple cases dealing with STATUTORY immunity, where they ended up DENYING immunity. What am I missing?
