The additional evidence for this is the COA races: there's an equally large ticket split happening there, with the D-aligned candidate named "Fatima" outperforming the D-aligned candidate named "Will" by 20% Ds went into the booth saying "hmm, which one *sounds* like a Dem?"

Low overall approval and high in-party approval is not that difficult to square. Last time we saw a president lacking significant juice within his own party was GWB second term when the base was mad about spending and immigration. DJT will never have that problem.

As Indiana goes, so goes the nation: Trump still has the juice with the GOP. His approval with them is the same or higher than in past midterm cycles. Most of the GOP say party leaders should follow Trump's lead. GOP lawmakers who mess with Trump get voted off the island.

@whignewtons This isn’t a matter of being consistent. Each case is different with different circumstances and facts. Different precedents and laws. Here his opinion was based on the statutory interpretation of the particular law and an originalist and textualist interpretation of the wording.

If Justice Kavanaugh is being consistent on a more expansive executive power, we'd expect him to appear more "liberal" during a Democratic administration and more "conservative" during a Republican one. And the reverse for a justice like Gorsuch who doesn't.

I just read Justice Thomas' dissent in the tariffs case. Even before reading Gorsuch's rebuttal, I find it the single weakest opinion from Thomas that I have ever read. And I'm a Thomas fan, in general. But this was nonsense -- and dangerous nonsense at that.

@robertwrighter And, she likely wasn't look AT HIM! She was looking at the guy trying to rip her out of the car. She may not have even known there was an agent in front of her. If the 2nd or 3rd shot, from the side of the vehicle, prove to be fatal, that's gotta be tried in a court.

Finally, a take I agree with. I’m watching the same video. I’m going back to read Barnes v Felix. I’ve worked on the highest profile police involved shootings. This is hard stuff. The people who think it’s easy—from either direction—are about outcomes and not process.

Opinions of the ICE shooting are pretty reliably tracking opinions about ICE and aggressive deportation raids. That shouldn't be the case. Cops on a bad mission might be legitimately forced to shoot someone who endangers them. And officers on a good mission can do bad things.
