🧵 Exposed: The "H-1B visa to B-2 visa Pivot." How a massive immigration loophole allows laid-off H-1B workers to stay in the U.S. indefinitely while avoiding a $100k fee. 📉🇺🇸 1/ The Loophole starts: ⏳ When an H-1B worker is laid off, they have a 60-day grace period to find another job or leave the country. Instead of leaving, many file to change status to a B-2 "visitor" visa—a tactical move to freeze their departure clock. 2/ The "Tourist" Mask: 🎭 Under the B-2, they get up to 6 months (on top of the 2-month grace period for H-1B visa holder) to "tour" while actually aggressively job hunting. While they can't work, they are permitted to interview, allowing them to maintain a local presence that American tech companies favor. They also utilize this time to learn new skills or technologies that be embellished with fake experience on their resumes. 3/ Avoiding the $100k Tariff: 💰 This move is a massive financial dodge. A Sept 2025 Presidential Proclamation hit new H-1B entries with a $100,000 "tariff on imported labor"; however, because the B-2 flip is an in-country "Change of Status" (COS), it is explicitly exempt from the fee. 4/ The "Flip": 🔄 Once a new sponsor is found, the employer files an H-1B transfer via COS. USCIS approves this as an internal adjustment, allowing the worker to return to H-1B status without ever leaving the country or undergoing consular processing abroad. 5/ Backup of backup: 🎓 If these former H-1B visa holders are still unable to land a job after 8 months, they then apply to shady universities or Day 1 CPT schools (with a 100% acceptance rate) to secure a F1 visa, while continuing to stay in the US. The key point being that a lot of these folks are not leaving the country and are continuing to clog the labor markets. Meanwhile... 6/ US Tech Grads sidelined: 🎓 While foreign workers use "visa flips" to linger indefinitely, American talent is struggling. Computer Science (CS) grads face ~6.1% unemployment, while Computer Engineering hits 7.5%—rates far higher than the overall national average. 7/ Entry-level crisis: 🤖 Entry-level roles are evaporating due to AI automation and hiring freezes. Thousands of talented U.S. graduates are applying to hundreds of jobs with zero offers, while visa-flippers snap up remaining openings. 8/ Follow the Money: 🏦 Why is this allowed? USCIS may be "addicted" to the revenue. The sources suggest they collect $2,805+ per filing for premium processing on these endless transfers and extensions, and closing loopholes could dry up that cash flow. Due to widespread fear and uncertainty within the immigration circles, I believe that most visa applications are being filed under the 'Premium Processing' category. 9/ The Fix: 🛠️ Policy reform is overdue: ✅ Require consular processing abroad for post-layoff H-1B reactivation to trigger the $100k fee at the end of the 60-day grace period. ✅ End the cycle of B-2 extensions for job hunting. ✅ Prioritize American graduates. Awesome detective work. I would encourage you to take this to the next level. For even the folks with legit diplomas and degrees, I would scrutinize their stated work experience. It's very common for some of these folks to undergo a 4-week bootcamp and graduate with 7 years of work experience, thanks to the elaborate racket run by the training institutions, recruiting agencies/bodyshoppers and the outsourcing companies. If you did the math on their claimed experience, some of these folks were supposedly working while still in high school.

Had a fun day today. 2 weeks ago an Indian (US Citizen) IT employee called ICE on his own department because he heard that many of them were here on fake H1-B Visas. 25 employees were arrested out of 100ish. He was correct. After talking to his leadership he also informed them that many here legally,but we're hired under false pretenses, because they had bought diplomas in India and never really got a degree. At this point management was worried they had been defrauded so they called me up to help them figure it out. We ran all of the remaining employees hiring paperwork through some AI analytics today. Massive amounts of documents. This included reading copies of diplomas, and and a ton of other personal documents. Training the AI analytics tool to look for irregularities in past work experience and education history. As an example: 1.) Check to see if the school exists 2.) Check to see if the person who signed the diploma actually worked at the university 3.) check to see if the degree listed is actually taught at that university 4.) ETC ETC ETC. We found that of the remaining 75 H1-b employees 50 of them had provided fake diplomas to either our company directly, or the contracting company they were hired through. So out of this one department of 250 people, 100 ish were from India here on visas, and 75 of them had defrauded the company during the hiring process. Either providing fake visa paperwork or falsification of education. Basically 75% lied. Not sure what they are going to do about it yet, as across the IT organization they have 1500 ish H1-B visa employees and they cannot fire 75% of them right now even if they wanted to, but I do know they are running all current visa employees records through the tool, any new applicants as well, and will be firing anyone who lied as soon as they get replacement in line for them. From the leadership I was working with: "We have to remove them, we cannot keep employees who defraud the company even if they are good and cheap"

@SanDiegoKnight My understanding is that they are primarily pursuing the small fish (mostly Indian owned bodyshopping companies). I'm not aware of any of the major companies currently being investigated. Is that due to regulatory capture?

@LayoffAI And nothing will happen due to regulatory capture. The watchdogs are promised jobs for either themselves or their family members in exchange for looking away. There occasionally will be some noise that something is being done about this fraud but it's mostly unknown companies.

New proposal just dropped on H-1B wages. The plan: Push wage floors higher at every level 17th → 34th 34th → 52nd 50th → 70th 67th → 88th All tied to Bureau of Labor Statistics data. @DeanTTraining I would recommend adding another column for age. Zone 2 cardio for older men is much different than that for men in their 30s. Recovery is slower among older men and chances of injuries go up exponentially.

The BEST Cardio for Fat Loss/Body Composition is… Zone 2 Cardio My preferred protocol: A ~10% Incline Walk @ 3-4 MPH I’ve prescribed Zone 2 Cardio to a lottttt of clients on their non-resistance training days NEVER seen it negatively impact a subsequent resistance training session Zone 3 - Zone 5 on the other hand almost always has a recovery demand Hence why it’s not the most ideal for body composition

It's the same rationale used by academia - employees on visas are more pliant and controllable than US citizens. There is rampant medical fraud at these hospitals but the employees on visas are less likely to act as whistleblowers to report their employer to the regulatory agencies.
