Uganda Law Society also called for the abolishing of committal proceedings describing them as useless, duplicative and delay the proceedings, and further argued that if the criminal jurisdiction of magistrate courts is enhanced, there is no reason to commit a person to a Magistrate Court which is going to try them. “But even with respect to the High Court, we strongly, strongly propose that abolish the committal proceedings. They serve no purpose. They are a legacy, duplicative procedural step that has no benefit except delay of trial. While passing the Computer Misuse amendment act in 2022, a member, I forget who it was, raised an issue about the manner in which it was being passed. The speaker, Among said, “let them go to court, we will see which Judge will agree with them. They are always abusing them too.” Today the Judges have agreed with us and nullified it. We hope all the victims of this unconstitutional act will be freed and compensated. This win is for us the petitioners but also for MP @GorrethNamugga. I remember the good fight she single-handedly put up against the kangaroo Parliament when the presiding officer was chest thumping and intimidating her. Also a big thanks to our lawyers🙏 The @JudiciaryUG has today given us a pleasant surprise. And a big shame to Asadu 👎

High Court finds that once a grant of probate has expired, it may only be “resurrected” through an application for renewal by extension made to the court that issued it, and that only a named executor in the grant has locus standi to apply for such renewal. In Mukundane Fide v Vincent Senyondo (Deceased) (Estate of the Late John Bwesigye), Misc. Application No. HCT-05-FD-MA-781-2025 (6 March 2026), Hon. Justice Nshimye Allan Paul M dismissed an application seeking revocation of probate, renewal of the same probate, and substitution of the deceased executor. On perusal of the application, the Court noted that the late Vincent Senyondo, who died on 12 March 2024, had been granted probate to the estate of the late John Bwesigye on 30 October 1997. The Court found that the grant of probate issued on 30 October 1997 expired on 31 May 2025 by operation of section 337(2) of the Succession Act, Cap 268, and that by the time the application was filed on 15 October 2025, the grant had already expired and was no longer valid. The Court noted that once a grant of probate has expired, it can only be “resurrected” through an application for renewal by extension made to the court that issued it under sections 255(3) or 337(4) of the Act. The Court further held that only a named executor in the grant has locus to file such an application under section 337(4), and since the applicant was not named as an executor in the expired grant, she had no locus to seek renewal. The Court also stated that the applicant could have moved the court before the grant expired to have it revoked for being inoperative under section 230(1) and (2)(d), but that option was not pursued before expiry. It added that where a grant of probate has been rendered inoperative, it becomes a basis for revocation under section 230(1) and (2)(d), and once revoked, the court may, under section 230(5), appoint a fit and proper person as administrator with the will annexed. However, in the judge’s view, the court could not revoke a grant of probate that was no longer valid after expiring on 31 May 2025. The Court advised that the applicant and beneficiaries may instead apply for letters of administration with the will annexed, since they were not named as executors in the will and the executor, Vincent Senyondo, had died. On the same occasion, ULS recognised Dr. Zedriga with a Lifetime Achievement Award in recognition of her contribution towards peace building, democratization, and the rule of law. Appearing before Museveni cadre judges is emotionally exhausting, it’s nauseating, it’s annoying, it’s disgusting, it’s deeply frustrating. Baguma, the cadre judge is arrogant, disrespectful, he is impunity itself. He simply rubbishes pleas from lawyers representing @kizzabesigye1 and Hajji Obeid. On a few occasions that KB attempts to fight for himself, Baguma just can’t let him do that. In my view @kizzabesigye1 was already convicted before being heard. In future, for the sake of my mental health, I may have to keep away from these proceedings. Not sure I am in position to restrain myself anymore in this kangaroo court. If I don’t keep away, I am likely to join KB in Luzira prison.
