3rd party approvals now. Hey @AriBFla, at what point is bureaucratic non response a taking? 1 year? 5 years? If cities are going to take power to control land use, isn’t there some reasonable responsibility (including responsiveness) that has to go with that? Isn’t there some reasonable cap?

Day 193 waiting on our "pre-approved" ADU permit. Called for an update. We learned Mondays are our plan check engineer's day off. Not just today. Mondays in general. He makes over $280k a year excluding benefits.

We submitted permits for a 2 bed 2 bath "pre-approved" ADU in Sherman Oaks on October 3rd 2024. That's 186 days ago. Still not approved. It's not in a coastal zone. We're not seeking a variance. It's a by-right ADU that per state law should be approved in 60 days.

@aaron_lubeck @alexisxrivas In some locales, lengthy inaction can trigger a right of action by the property owner to secure immediate approval. I quite like that approach. Strikes me as more workable than litigating it as a taking, which is always hard to win on.
