The organizers can say "Muslim-only" because they are hosting a private event on rented property. The city/waterpark isn't required to (and doesn't) police the religious preferences of every private group that rents the space. If the park refused to rent to them because they are Muslim, that would likely be illegal. The reverse, allowing the private group to set its own rules, is allowed. A main reason in many has been "statutory" - in which case the court does not even begin to look at evidence. But, I promise you, we will all know soon enough what I'm talking about.
