@fresh_curryleav @hriengaalkn If using toilet of their sex causes them distress, then yes they are disabled. Old EHRC Code of Practice and the new one both acknowledged that gender dysphoria is considered a disability where it interferes with daily living. This would qualify as that.

@Flo_Albright @hriengaalkn the point is many trans ppl aren't disabled and don't need to use accessible toilet, they're being forced to. Like you're disabled, use the accessible toilets, don't support policies that push other ppl from using other facilities. It's not hard to understand

@galluslass @louderry I also wanted to know. Not least because my local store has three changing rooms, so keeping two separate sex and having one gender neutral seems more proportionate. I contacted them through their website to ask. Suggest anyone impacted does same, if they have bandwidth to do so

@fiona_emm @TheVikingDane Yes, fully enclosed facilties cause their own issues. They are also much larger than single sex and need a large area to open onto, so more expensive to provide. Toilets come with H&S risks as if people collapse in them, you can’t see them as easily as cubicles.

@Flo_Albright @AlessandraAster nearly. "equality before law" is what treats everyone the same. the equality act is actually exceptions to this principal where you're allowed to legally discriminate. in this case you can discriminate by sex to create single-sex spaces. otherwise i agree.

I am not sure this is the case. The Equality Act could have said that the sex exceptions are designed to avoid direct and indirect sex discrimination. But it does not. The most it says is that someone could reasonably object or the service would be less effective.

EHRC guidance explains that being in a state of undress is one of the reasons likely to make single sex legitimate.

@AlessandraAster this is the part of the guidance that i didn't quite follow. my limited understanding was that solely unisex provisions are fine where every toilet or changing cubicle is a complete private lockable room that caters to both sexes.

@AlessandraAster This is directly from the EHRC’s draft Code of Practice. It’s in the section on Justifications for Single Sep & Single Sex Services . I wrote to M&S recently and they said they were waiting for it to be laid to consider all their responsibilities.

@SnifflyPanda So long as they’ve done an Equalities Impact Assessment and can show that their demographic needs GN, not single sex. I’ve never heard a middle age lady complain she doesn’t like single sex changing rooms and would like gender neutral, so I’d guess they haven’t done this.
