A BILL
To authorize and direct the apprehension, detention, and removal of certain noncitizen members of Tren de Aragua under the Alien Enemies Act, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Tren de Aragua Alien Enemies Enforcement Act of 2025.”
SECTION 2. FINDINGS.
Congress finds the following:
1.Designation as Foreign Terrorist Organization. Tren de Aragua (TdA) was designated as a Foreign Terrorist Organization by the Secretary of State on February 20, 2025, pursuant to section 219 of the Immigration and Nationality Act (8 U.S.C. 1189), following consultation with the Attorney General and the Secretary of the Treasury.
2.Criminal Activities and Threats. TdA, with thousands of members, many of whom have unlawfully entered the United States, engages in brutal crimes, including murders, kidnappings, extortions, and human, drug, and weapons trafficking, posing a significant threat to public safety and national security.
3.Affiliation with Foreign Entities. TdA operates in conjunction with the Cártel de los Soles, a narco-terrorism enterprise sponsored by the Nicolás Maduro regime in Venezuela, and has infiltrated the Maduro regime’s military and law enforcement apparatus, supporting efforts to destabilize democratic nations, including the United States.
4.Invasion and Irregular Warfare. TdA is perpetrating, attempting, and threatening an invasion or predatory incursion against the territory of the United States, conducting irregular warfare, and using drug trafficking as a weapon against United States citizens.
5.INTERPOL Confirmation. In December 2024, INTERPOL Washington confirmed that TdA has emerged as a significant threat to the United States by infiltrating migration flows from Venezuela.
6.Historical Context. TdA grew significantly under Tareck El Aissami, former governor of Aragua (2012–2017) and Vice President of Venezuela, who was designated a Specially Designated Narcotics Trafficker by the United States Department of the Treasury under the Foreign Narcotics Kingpin Designation Act (21 U.S.C. 1901 et seq.) and is a fugitive facing charges for violating United States sanctions.
7.National Security Imperative. The activities of TdA constitute a hybrid criminal state threat, necessitating immediate action to protect the American people from the devastating effects of this incursion.
SECTION 3. DEFINITIONS.
In this Act:
1.Alien Enemy. The term “Alien Enemy” means any Venezuelan citizen who—
•is 14 years of age or older;
•is a member of Tren de Aragua, as determined by the Attorney General or the Secretary of Homeland Security;
•is present within the United States; and
•is not a naturalized citizen or lawful permanent resident of the United States.
2.Tren de Aragua (TdA). The term “Tren de Aragua” refers to the transnational criminal organization designated as a Foreign Terrorist Organization under section 219 of the Immigration and Nationality Act (8 U.S.C. 1189).
3.Maduro Regime. The term “Maduro Regime” refers to the government of Venezuela under the control of Nicolás Maduro, including its military, law enforcement, and affiliated narco-terrorism enterprises such as the Cártel de los Soles.
SECTION 4. AUTHORIZATION TO INVOKE ALIEN ENEMIES ACT.
(a) Declaration of Invasion. Congress declares that Tren de Aragua is perpetrating, attempting, and threatening an invasion or predatory incursion against the territory of the United States, both directly and at the direction, clandestine or otherwise, of the Maduro regime in Venezuela.
(b) Authority Under Alien Enemies Act. Pursuant to the Alien Enemies Act (50 U.S.C. 21), the President is authorized to designate as Alien Enemies all individuals meeting the criteria set forth in section 3(1) of this Act, who shall be liable to be apprehended, restrained, secured, and removed from the United States.
(c) Scope of Application. This authorization shall apply to all land and water, continental or insular, within the jurisdiction of the United States.
SECTION 5. DIRECTIVES FOR IMPLEMENTATION.
(a) Responsibilities of the Attorney General and Secretary of Homeland Security. The Attorney General, in consultation with the Secretary of Homeland Security, shall—
1.Issue guidance necessary to effectuate the prompt apprehension, detention, and removal of Alien Enemies as defined in section 3(1) of this Act, effective immediately upon issuance;
2.Utilize all available resources, including federal, state, and local law enforcement, to enforce the provisions of this Act;
3.Coordinate with the Secretary of the Treasury to seize property linked to TdA’s activities within the United States, consistent with applicable law.
(b) Regulations. The Attorney General is authorized, pursuant to the Alien Enemies Act (50 U.S.C. 21) and section 301 of title 3, United States Code, to establish regulations necessary to carry out the purposes of this Act, including procedures for identifying TdA members and ensuring compliance with due process requirements.
(c) Reporting Requirement. Within 180 days of the enactment of this Act, the Attorney General and the Secretary of Homeland Security shall jointly submit a report to Congress detailing—
1.The number of Alien Enemies apprehended, detained, and removed under this Act;
2.The resources allocated to enforcement efforts;
3.Any challenges encountered in implementation and recommendations for addressing such challenges.
SECTION 6. SEVERABILITY.
If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the remainder of the Act, and the application of such provision to other persons or circumstances, shall not be affected thereby.
SECTION 7. EFFECTIVE DATE.
This Act shall take effect immediately upon its passage.
