@ClarenceMaximus You’re totally right that Andy Oldham wouldn’t have to “shift leftward.” On many of the most crucial issues facing conservatives, he’s already there.

“No more Souters” is one of the most misused refrains out there right now. What it should mean is “no more nominees who don’t have a long paper trail to judge their jurisprudence on.” What the dumbest of the right use it to mean is “there’s some undetectable force on the Court that just turns conservative justices into liberals unless they are hackish enough to resist.” These people think that Souter was at some point a conservative and that he just wasn’t principled enough, so he flipped. But Souter WAS NEVER CONSERVATIVE/ORIGINALIST! It’s obvious even just from his confirmation hearings. The whole point is that there was no real record to judge him on, so everyone got duped. ALL of the squishier justices, Kennedy, O’Connor, Roberts etc… never purported to be originalists in the first place. Judges like Oldham, Bumatay, or Rao, who all have long records where they are consistently originalist, are not going to suddenly shift leftward if they get on the Court. That just hasn’t happened, and it is not the lesson of Souter. The lesson is literally just that you should not nominate someone who hasn’t made clear what their judicial philosophy is through their opinions.

James Ho's fine, but I'd go for Lawrence VanDyke over him. One reason being VanDyke's willingness to call out the liberals on the Ninth Circuit. VanDyke's colleague Kenneth Lee also recently slammed "resistance" judges. Having such forthrightness on SCOTUS would be good.
