آج ایک بھارتی عدالت نے ممتاز کشمیری حریت رہنما آسیہ اندرابی کو دو مرتبہ عمر قید کی سزا سنائی ہے۔ اسی مقدمے میں ان کی ساتھیوں ناہیدہ نسرین اور فہمیدہ صوفی کو 30 سال قید کی سزا دی گئی ہے۔ یہ تینوں کشمیری خواتین 2018 سے نئی دہلی کی بدنام زمانہ تہاڑ جیل میں قید ہیں۔
یہ فیصلہ نہ صرف کشمیری عوام کی آواز کو دبانے کی ایک اور کوشش کے طور پر دیکھا جا رہا ہے بلکہ انسانی حقوق کے عالمی اصولوں پر بھی سنگین سوالات اٹھاتا ہے۔ خاص طور پر اس بات پر تشویش ہے کہ یہ خواتین عمر کے اس حصے میں ہیں جو 60 سال سے زائد ہے، اور اس کے باوجود انہیں سخت قید و بند کا سامنا کرنا پڑ رہا ہے۔
ناقدین کا کہنا ہے کہ اس طرح کے فیصلے نہ صرف اقوام متحدہ کی سلامتی کونسل کی قراردادوں (UNSCR) کی روح کے خلاف ہیں، جو جموں و کشمیر کے مسئلے کو ایک متنازعہ علاقہ تسلیم کرتی ہیں، بلکہ یہ بین الاقوامی انسانی حقوق کے قوانین جیسے Universal Declaration of Human Rights (UDHR) اور International Covenant on Civil and Political Rights (ICCPR) کے بنیادی اصولوں سے بھی متصادم ہیں۔
مزید یہ کہ کئی ماہرین کے مطابق ایسے اقدامات خود بھارت کے آئین کی روح سے بھی متصادم ہیں، جس میں شہری آزادیوں، اظہار رائے کی آزادی اور انسانی وقار کے تحفظ کی ضمانت دی گئی ہے۔ بزرگ خواتین کے ساتھ اس طرح کا سخت سلوک انصاف، انسانی ہمدردی اور قانون کی بالادستی کے اصولوں پر بھی سوال اٹھاتا ہے اور یہ دونوں کشمیری اور ہندستانی روایات کے منافی بھی ہے-
Today, an Indian court sentenced Kashmiri Hurriyat leader Aasiya Andrabi to two life imprisonments. In the same case, her colleagues Naheeda Nasreen and Fehmeeda Sofi were each sentenced to 30 years in prison. All three Kashmiri women have been held in Tihar Jail in New Delhi since 2018.
Many observers believe this decision raises serious concerns about human rights and the suppression of political voices in Kashmir. It is especially troubling that these women are over the age of 60, yet they continue to face long and harsh imprisonment.
Critics argue that such actions contradict the spirit of the United Nations Security Council Resolutions (UNSCR) on Jammu and Kashmir, which recognise the region as a disputed territory and call for a peaceful resolution according to the will of the Kashmiri people.
Furthermore, this situation raises questions about compliance with international human rights laws, including the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR).
Legal experts also point out that these measures may conflict with the principles of the Indian Constitution, which guarantees fundamental rights such as freedom of expression, personal liberty and human dignity. The harsh treatment of elderly women in prolonged detention also raises humanitarian concerns, as well as both Kashmiri and Indian cultural disrespect for women.
