ADVOCATE ERIAS LUKWAGO MUST STOP ATTACKING JUDGES IN THE MEDIA Has anyone seen advocate Lord Mayor Erias Lukwago attack Justice Musa Ssekaana on @ntvuganda tonight? If this isn’t professional misconduct, what is it? 🤷‍♂️ He called Court’s ruling a “midnight ruling” conveniently forgetting that the injunction/interim order that kept him in office when Jennifer Musisi was ED was issued and served before 9:00 am, which he calls court hours. Anyone who has for example, ever seen or been part of Presidential petitions in Uganda and Kenya will tell you that the Constitutionally set time limits within which petitions must be heard and decided mean that Court proceedings often proceed well into the night. Mr. Lukwago is therefore being very dishonest, intellectually at least. In fact, if our courts hired contract judges with some working night shifts, we would cover work ordinarily done in two years in one year & reduce or eliminate backlog. Apparently, Mr. Lukwago has never won any case before the said Justice. This in itself cannot be the evidence of either bias or the Judge being wrong. Cases are decided on their own merits and not on the law of averages. The logic cannot be that you are entitled to win the tenth time because you have lost the previous nine. Each case is to be treated as brand new. That’s the ideal. A senior colleague taught me that a trial judge who wrongly rules against you inadvertently makes you money because when you win on appeal, you get “costs here and in the court below” Mr. Lukwago is a generally very experienced and successful litigation lawyer. He knows what he and his unsuccessful clients ought to do if they are unhappy with a Court decision. Part of the challenge here might be that the client is also the advocate. @KakandeAlex @AgaSekalala I think it's important for individuals to be less greedy and more logical when making decisions. The problem with speculating based on excitement & little knowledge is what leads many to lose their money. Interestingly, everything is a bet, and many times we lose. #capitalchicken
