The Barnstable County Assembly of Delegates met yesterday to discuss an ordinance aimed at further restricting ICE operations on Cape Cod. Great update. I like your positive tone. Hopefully things go real well in the near future for mom and child. I remain incredibly frustrated at the way the father abused the system, doing so much harm. I hope Massachusetts can fix this broken system. Maybe Kelsey can sue and seek a little justice that way.

As the temporary custody hearing in the Kelsey Fitzsimmons' probate case is set to be heard tomorrow, the case of Angelone v. Angelone serves as a reminder that for the last forty years courts have made clear that mental health issues are only relevant if they directly impact the safety of a child. In that case, the father appealed the grant of custody to the mother claiming to be the “superior” parent because the mother had been voluntarily hospitalized a few times for mental health issues and had at times suffered from depression. The Court disagreed with the father and upheld custody to the mother writing: "In our opinion, on the evidence before her, the judge could permissibly conclude: (a) that Marie is dealing successfully with her emotional problems; (b) that of the two parents ‘she despite her problems can offer the children more room for growth’; (c) that Gino has an ‘obsession’ with keeping control over the life of his wife and children which causes much of her stress; and (d) the welfare of the children will best be served by granting custody to their mother, with liberal and specific rights of visitation for the father." The law is the same today. Evidence that mental health issues have resolved or are resolving and do not impact safety of a child will not preclude a grant of custody.
