UPDATE ON THE GARKI MARKET, ABUJA, INCIDENT INVOLVING DSS STAFF It would be recalled that the Department of State Services (DSS) had earlier issued a statement in respect of a 7th September, 2023 incident involving its Staff and some members of the public at Garki Market, Abuja. This is to further inform the public that the Service has constituted an in-house investigative team on the matter. While the inquiry is ongoing, the Service has visited the two injured persons at the different hospitals where they are receiving treatment. It committed to the payment of the medical bills and made required deposits in this regard. To show sincerity of purpose at the time of the visits, the Service expressed readiness to move them to its world class medical facility in Abuja. It could have undertaken these actions even if its staff were not involved. Though these efforts are not, in any way, in admission of guilt (as investigation is yet to be concluded), the Service believes that the victims deserve empathy, financial support and justice. While it is in regular contact with their families or guardians, it will continue to follow up on their recovery and progress. However, the DSS reassures the public that the victims are upbeat and responding well to treatment. The public may wish to note that the Service has not interfered with the investigation of the Police which is also detaining its Staff suspected to be involved in the incident. The Service’s position is not only to ensure justice for the victims, but it is in line with its avowed commitment to transparency, accountability and rule of law. Nevertheless, updates of this nature will always be made available till the matter is finally resolved. I am not convinced about that double nomination ruling though. Why introduce mens rea (intent) in a double nomination case? A combination of actus reus (the act) and mens rea (the intent) is only relevant in establishing whether a crime has been committed. The two must be present for a crime to be proven. Double nomination is not a crime, so the test should simply be “Was there double nomination or not?” Mens rea (intent) to be double-nominated or to benefit from double nomination is totally irrelevant. To my mind, the 25% issue was a non-starter. The forfeiture issue, although odious and offensive to morality, did not actually offend the Constitutional eligibility to run for office, if you look at it with the cold lens of legality. But you see that double nomination? It was simply a matter of dates. According to the dates, was there double nomination according to the Electoral Act or not? Intent is irrelevant. I look forward to hearing the Supreme Court’s views. And before you abuse me, respect my track record of often being right. 😊

Once elections have been held and a winner is announced, we must follow the Jonathan doctrine and accept the people's verdict in the interest of democracy and the nation. Our elections don't have to end in the courts. But now that we have found ourselves in this position, and the courts have spoken, let us put national interest above self-interest, accept the verdict, and move on so the nation can advance. Bola Ahmed Tinubu, @officialABAT, is the duly elected and undisputed President of Nigeria, @NGRPresident, and this judgment should settle all questions and erase all doubts. I commend the judges of the Presidential Election Petition Court for doing a challenging job exceptionally well. It was democracy that won. So, I commend both the President and his challengers. Coincidentally, this verdict is coming as the President marks a hundred days in office, days that have been eventful, effective and decisive. And now, without this unnecessary uncertainty hanging over his head, we can expect even better days. Finally, I call on supporters of all the parties to this now settled case to be mindful of recent events on our continent and thus tailor their words and actions to promote the peace, progress and prosperity of Nigeria as one democratic and united nation under God. #PEPCJudgment
