This new #h1bvisa update proposing a $100K fee is more difficult to parse through and understand than it was for DTJ to pronounce #acetaminophen. Our take: Does the fee only apply to “new employment” H-1Bs? We don’t know. Do amendments require the $100k fee? We don’t know. Do change-of-employer petitions require the $100k fee? We don’t know. Do extensions require the $100k fee? We don’t know. How do we pay the $100k fee? We don’t know. How do we evidence payment of the $100k fee? We don’t know. Are cap-exempt petitions subject to the $100k fee? Looks like it. What does the quality of this proclamation tell us? Either the person who wrote it doesn’t understand the nuances of the H-1B, or they are intentionally trying to create chaos. We definitely expect lawsuits for this one, so follow along and stay tuned.

@BoredJamesBored @DHSgov @CBP There is no way that undocumented folx have caused any delay in your case. You can blame the backlog, understaffing, and 30 yrs of not updating immigration policy. If you are being sponsored by a relative, those can take YEARS, and again, if you want to blame, it's the system.

I’m kinda ticked they’re getting a free flight and $1,000 for their “troubles” as well as the opportunity to come back. They don’t deserve any of that. I’ve been waiting SIX YEARS in immigration hearings as a direct result of these people budding in front of me bogging down the system. My grandfather and father are American citizens. Go figure. 🤦🏼

DHS has made it abundantly clear that those who are in our country illegally have a CHOICE—they can leave the country voluntarily or be arrested and deported. If they choose the easy way, the United States taxpayer is generously offering illegal aliens who use the @CBP Home App free flights, the ability to control their departure, $1000, and the potential opportunity to come back the legal, right way. If they choose the hard way they will be arrested and deported.
